It has been determined by the Village Building Inspector and the Village Engineer that a large area within the Village, because of a combination of the elevation, the water table, and the porosity and percolatability of the soil, that basements and cellars within such areas are prone to extensive and substantial flooding. In addition, the underground construction necessary to provide basements and cellars in said area has diverted underground water flows and otherwise inflicted adverse impacts upon surrounding properties. Accordingly, in order to protect the future residents and owners of any properties within that area, it is essential that new construction of basements and/or cellars should not be permitted within that area.
As used in this chapter, the following terms shall have the meanings indicated:
BELOW-GRADE FLOOR
Any basement, cellar, or other level of a structure which has any portion of its floor elevation below any portion of the adjacent exterior grade of the structure it is within.
FLOOD-PRONE AREA
The properties shown on the map entitled "Village of Great Neck Building Zone Map, Nassau County," prepared by H2M Group, adopted by the Board of Trustees on January 20, 2015, a copy of which is on file with the Village Clerk. At the said date of adoption, said properties were described on the Nassau County Land and Tax Map as being within Section 1 and the following blocks and lots:

No new building or other structure shall be constructed within the flood-prone area with any below-grade floor.
In the event of unnecessary hardship, an application for relief from this chapter may be made to the Village's Zoning Board of Appeals pursuant to the provisions of Village Law § 7-712-b(2) for a use variance.
