No person shall cause or permit to take place on public or private property
in the Village any parade, exhibition, concert, theatrical performance, dog
show, antique show, horse show, public fireworks display or other similar
performance or display without first obtaining a permit therefor from the
Village pursuant to this chapter.
An application for such a permit shall be written and verified, shall
be filed with the Village Clerk at least 30 days before the proposed activity,
and shall set forth:
A.
The name and address of the applicant.
B.
The name and address of the person responsible for the
conduct of the proposed activity.
C.
A full description of the nature of the proposed activity.
D.
The number of persons expected to attend.
E.
Details with respect to sanitary facilities, if needed,
and off-street parking.
F.
Date, time and duration of the proposed activity.
G.
In the case of an application for a permit for a public
display of fireworks, the information required by the Penal Law of the State
of New York.
A.
The Mayor, or an official of the Village designated by
the Mayor for such purpose, may issue permits pursuant to this chapter, subject
to such conditions as may be reasonable to protect the public health, safety
and general welfare and, in particular, to protect residents of the area in
which the activity is proposed to be conducted from noise and inconvenience,
to protect and preserve the residential character of the Village, and to ensure
compliance with all applicable laws, rules and regulations.
B.
Any person aggrieved by a determination to issue a permit pursuant to Subsection A of this section may appeal to the Board of Trustees, by written application no later than seven days after the issuance of the permit. In acting upon any such appeal, the Board of Trustees may affirm or reverse the determination appealed from, or modify the same in any manner which would have been authorized for an original permit issuance pursuant to Subsection A of this chapter.
The fee for an application for a permit pursuant to this chapter shall
be determined by resolution of the Board of Trustees. In appropriate cases,
the Board of Trustees may waive or reduce the fee required to be paid by a
charitable, educational or religious not-for-profit organization.
