The Board of Trustees, due to conditions of the trucking and transport
of garbage and rubbish through the Village and the collection of such garbage
and rubbish in the Village, has found it necessary for the preservation and
care of the safety, health, comfort and general welfare of the inhabitants
of the Village to regulate the collection and carting of garbage and rubbish
within the Village.
As used in this article, the following terms shall have the meanings
indicated:
Any animal or vegetable refuse and waste matter, dead animals, offal
and swill.
Sweepings from buildings, boxes, barrels, bottles, papers, rags,
excelsior, straw, old clothes, shoes, bedding, furniture and small metal,
rubber or wooden scrap.
No person or persons, firm, association or corporation, agents or employees
engaged in the business of collection and/or carting of garbage and/or rubbish
within the Village shall conduct such business without first procuring a license
for the same.
No person or persons, firm, association or corporation shall employ
an unlicensed driver in the collection and/or carting of garbage and/or rubbish
in the Village.
Any person or persons, firm, association or corporation who shall hereafter
desire a license to conduct the business of collection and/or carting of garbage
and/or rubbish in the Village shall apply in writing to the Mayor of the Village
for the issuance to him, them or it of a license therefor, which application
shall state the place of business of the applicant, the nature of the business,
the number of trucks used in said business, with a description of the devices
or equipment on said trucks for the prevention of spilling or dropping of
said garbage or rubbish, the names and addresses of the officers of the corporation
or association and the drivers of said vehicles, together with the address
of the officer, in the case of a corporation, upon whom process or other legal
notice may be served. Notwithstanding the foregoing, the Village shall issue
a license without application therefore, upon presentation of a valid current
license from the Town of North Hempstead for the same authorization as sought
from the Village.
The Mayor of the Village is hereby empowered to issue such license to the person or persons, firm or association applying therefor, in the form and manner provided by law, and to specify therein the name of the Village, the license fee as set forth in Chapter 130, Fees. No such license shall be issued by the Mayor of said Village unless such person or persons, firm or association has complied with each and all of the ordinances duly enacted by the Board of Trustees of the Village of North Hills, and no such license shall be granted by the Mayor of said Village unless there shall be annexed to the application therefor an agreement in writing, duly signed by the applicant, to the effect that such applicant will in all respects duly comply with all rules and regulations adopted by the Board of Trustees, with respect to the collection and/or carting of garbage and/or rubbish in the Village.
Any license may be refused by the Mayor of said Village for the collection
and/or carting of garbage and/or rubbish in the Village where in the judgment
of the Mayor such collection and/or carting of garbage and/or rubbish by the
applicant shall be detrimental to the safety, health, comfort and general
welfare of the inhabitants of the Village.
Every such license shall be countersigned by the Clerk of the Village,
who shall keep a record thereof and of the amount of the fee to be paid therefor,
and upon presentation of such license to the Treasurer of the Village, so
signed and countersigned, and the payment to the Treasurer of said fee, the
Treasurer shall endorse thereon his receipt of the license fee. The license
shall not take effect until the receipt of the Treasurer shall have been endorsed
thereon.
Any applicant who shall have been refused such license by the Mayor
may apply to the Board of Trustees at a meeting thereof, and the same may
be granted or refused by the said Board of Trustees.
The Mayor of the Village may suspend any such license until the next
meeting of the Board of Trustees and thereupon the said license may be revoked
or continued by the Board, and it shall become the duty of the Mayor to suspend
any such license and of the Board of Trustees to revoke the same in the event
that any licensee shall violate the regulations herein prescribed as to the
equipment and devices for the prevention of spilling or dropping of garbage
and/or rubbish in the Village and the conduct of such business of collecting
and/or carting of garbage and/or rubbish.

Pursuant to General Municipal Law § 120-aa, the New York State
Legislature has directed that each municipality in the State of New York adopt
local legislation requiring that solid waste which has been left for collection
or which is delivered by the generator of such solid waste to a solid waste
management facility shall be separated into recyclable, reusable or other
components for which economic markets for alternate uses exist. It is the
intention of the Village of North Hills to conform to that requirement by
the enactment of this article.
A.
The Board of Trustees, from time to time, by resolution,
may establish regulations:
(1)
Specifying those recyclable or reusable materials, including
but not limited to glass, metal and plastic containers, and newspapers, or
other components, which materials shall not be commingled for pickup with
any other solid waste materials and which shall be separated from other solid
waste materials in accordance with such regulations.
(2)
Designating the place(s) and time(s) when such recyclable
or reusable materials may be placed for pickup, collection and recycling.
B.
No person shall cause or permit any recyclable or reusable materials designated in or pursuant to Subsection A hereof to be commingled with any other solid waste materials for pickup, collection and recycling.
C.
No person shall cause or permit any such recyclable or
reusable material to be placed for pickup, collection and recycling except
in containers approved by the Board of Trustees for that purpose.
D.
No person shall cause or permit any such recyclable or
reusable material to be placed for pickup, collection and recycling and reuse
except at such times and places as may be designated by the Board of Trustees.
