A. 
Required. The operator of a vehicle shall obey the instructions of any official traffic control sign, signal, marking or device applicable thereto placed in accordance with the provisions of this chapter or of the Vehicle and Traffic Law, unless otherwise directed by a traffic or police officer, subject to the exceptions granted the operator of an authorized emergency vehicle in the Vehicle and Traffic Law.
B. 
Signs. No provisions of this chapter or of the Vehicle and Traffic Law for which signs are required shall be enforced against an alleged violator if at the time and place of the alleged violation an official sign is not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular section does not state that signs are required, such section shall be effective even though no signs are erected or in place.
A. 
Prescribed. Pursuant to the provisions of § 1662-a of the Vehicle and Traffic Law, the Town Board may prescribe the speed at which vehicles may proceed upon the public streets and highways of the Town.
B. 
Signs required. The Town Board shall cause suitable signs to be erected indicating the speed at which vehicles may proceed on such public streets and highways within the Town.
C. 
Obedience required. It shall be unlawful for any person to operate a vehicle in excess of the speed limits indicated on the signs erected pursuant to Subsection B.

A. 
Authority. The Town Board may, at such time as it deems advisable, designate streets, avenues or roads in the Town, or parts thereof, as through streets.
B. 
Signs required. Conspicuous signs or signals shall be displayed at all points where through streets have been established.

The Town Board may, at such time as it deems advisable, authorize the Police Department to place yield signs at any intersection of streets or highways, and the erection or placing of such yield signs shall be presumptive evidence that such signs were erected and placed at the direction of the Town Board.

A. 
Authority; signs required. Pursuant to § 1660(a)(16) of the Vehicle and Traffic Law, the Town Board is hereby authorized to designate public streets and highways in which vehicles shall pass in one direction only and the time such restrictions shall be in effect, and shall cause such streets and highways to be marked by suitable signs during the hours in which such designation is to be observed.
B. 
Obedience required. It shall be unlawful for any person to pass, drive or operate any vehicle along, over or through any such street or highway in a direction opposite or contrary to the direction designated as provided in Subsection A.

A. 
Title.
This section shall be known as the "Orchard Park Town Residential Truck Traffic Limitation Law of 2023."
B. 
Legislative intent. The Town Board of Orchard Park, recognizing the need to protect the safety and well-being of residents and maintain the integrity of residential neighborhoods, hereby enacts this law to limit truck traffic on Town residential roads in accordance with the authority granted by § 1660 of the New York State Vehicle and Traffic Law.
C. 
Definitions. For the purpose of this section, the following definitions shall apply:
TRUCK
Any vehicle, including but not limited to trucks, commercial vehicles, tractors, tractor-trailer combinations, tractor-semitrailer combinations, or tractor-trailer-semitrailer combinations, having a total gross weight in excess of ten thousand pounds as permissible by Section 1660(a)(10) of the New York State Vehicle & Traffic Law.
TOWN RESIDENTIAL ROADS
Roads within the Town of Orchard Park that are classified as residential, excluding highways maintained by the State of New York or the County of Erie.
D. 
Limitation of truck traffic:
(1) 
The Town Board of Orchard Park hereby designates all Town residential roads, excluding highways maintained by the State of New York or the County of Erie, as restricted areas for trucks, as defined in Subsection C of this section, except for the purpose of local delivery or pickup of merchandise or other property.
(2) 
The exclusion specified in Subsection D(1) shall be communicated through appropriate signage at the entrances to Town residential roads.
E. 
Exceptions:
(1) 
The limitation on truck traffic imposed by this section shall not apply to:
(a) 
Emergency vehicles.
(b) 
Vehicles granted permits by the Town Board for essential local pickup or delivery services, as per the provisions of § 1660(a)(11) of the New York State Vehicle and Traffic Law.
F. 
Enforcement:
(1) 
Violation of this section shall be subject to penalties as provided by applicable state laws.
(2) 
The Orchard Park Police Department is authorized to enforce the provisions of this section.
G. 
Repeal of prior laws. This section hereby repeals and replaces all prior laws and ordinances of the Town of Orchard Park related to the subject matter herein.
H. 
Severability. If any part or provision of this section or its application to any person or circumstances is adjudged invalid, the judgment shall not affect other provisions or applications of this section which can be given effect without the invalid part or application.
I. 
Effective date. This section shall take effect 30 days after filing with the Secretary of State.
A. 
Designation. The Town Board shall have the authority to designate streets or parts of streets where parking is prohibited and shall cause such streets or parts of streets to be marked by suitable signs or other devices.
B. 
Effect. When such streets or parts of streets are established as areas where parking is prohibited as provided in Subsection A, it shall be unlawful for any person to stop, stand or park a vehicle upon such street in violation of such prohibition.

A. 
Designation. The Town Board shall have the authority to designate streets or parts of streets where parking time limits have been established, and shall cause such streets or parts of streets to be marked by suitable signs or other devices indicating the parking time limits and the periods when such time limits shall take effect.
B. 
Effect. When parking time limits are established for a part of a public street, highway or public parking area and such places are appropriately signposted or marked to indicate the parking time limit, it shall be unlawful for any person to park or leave standing any vehicle upon such public street or highway or public parking area in violation of such parking time limit.
C. 
All public streets, roads and highways in the Town of Orchard Park, outside of the Village of Orchard Park, are hereby designated as a restricted parking district from 1:00 a.m. to 7:00 a.m. during the period from November 1 to April 1 in each year.
D. 
The owner or operator of any vehicles removed from a restricted parking district, pursuant to the provisions of this section, shall be liable for the payment of charges for such removal and storage.

A. 
Designation. The Town Board shall have the authority to designate streets or parts of streets as loading zones and shall cause such areas to be marked by suitable signs or other devices.
B. 
Effect. No person shall park or leave standing any vehicle within a space designated as a loading zone and suitably marked as such, except for the exclusive purpose of loading and unloading.

A. 
Designation. Pursuant to the Vehicle and Traffic Law, the Town Board is hereby authorized to designate safety zones and bus, cab or taxicab stands in the public streets or highways of the Town and in parking areas either owned, operated or controlled by the Town, and to limit or prohibit parking in spaces and zones in said streets, highways and parking areas, and to cause such zones, spaces and stands to be marked and indicated by suitable signs.
B. 
Signs for bus stops. Spaces specified as parking and stopping places for buses shall be marked and indicated by suitable stationary and portable signs indicating the location and extent of such places so reserved.
C. 
Effect. No person shall park or leave standing any automobile or other vehicle except a bus within a space designated as a bus stop, and except a taxicab within a space designated as a taxicab stand and suitably marked as such within the Town.

In the event of a fire or other emergency, to expedite traffic or to safeguard pedestrians or property, any police officer or other person empowered to regulate traffic in the Town of Orchard Park may direct traffic as the conditions may require notwithstanding the provisions of the Vehicle and Traffic Law or of local laws, ordinances, orders, rules, regulations, Administrative Code or Sanitary Code provisions of the Town of Orchard Park regulating traffic.
