As used in this article, words in the singular
shall include the plural; and those in the plural shall include the
singular. The words "shall" and "will" for the purpose of this article
are defined as mandatory.
As uses in these regulations, additional specific
terms or words shall be defined as follows, and any pertinent word
or term not a part of this listing but vital to the interpretation
of these regulations shall be construed to have its legal definition:
BUILDER
A person, who is not necessarily the owner of the land or
agent of the same, who, by contract or other agreement, is charged
with the responsibility of construction of buildings or other structures,
or of making any construction improvements on any parcel of land.
PERSON
Any person, firm, partnership, association, corporation,
governmental unit, company or organization of any kind.
TRUCK
Any vehicle or piece of heavy equipment used, designated
or operated for the transportation of property or materials.
At the time a builder makes application to the
Zoning Officer for the issuance of a building permit, he shall file
with the Township the names and addresses of all individuals who will
be transporting construction equipment to and from the building site.
Any person who shall damage the Township roads
while transporting construction equipment to and from a building site
shall be responsible for the repair of the said damage and shall be
further responsible for the removal of all mud, gravel or other debris
deposited on the Township roads by said construction equipment.
The Board of Supervisors, or any officer or employee of the Township designated thereby for the purpose, is hereby authorized to give notice, by personal service or by United States mail, to the builder or person responsible for the damage caused to any Township road of the provisions of §
235-31 of this article, directing and requiring such person to repair said damage or remove such debris; so as to conform to the requirements of this article within five days after receipt of such notice. In any case any person who shall neglect, fail or refuse to comply with such notice, within the period of time stated therein, Township authorities may repair the said damage or remove such debris; and the cost thereof, together with any additional penalty authorized by law, may be collected by the Township from such person, firm or corporation, in the manner provided by law.

Any person, firm or corporation who shall violate
any provision of this article, upon conviction thereof in an action
brought before a District Justice in the manner provided for the enforcement
of summary offenses under the Pennsylvania Rules of Criminal Procedure,
shall be sentenced to pay a fine of not more than $1,000 plus costs
and, in default of payment of said fine and costs, to a term of imprisonment
not to exceed 90 days. Each day that a violation of this article continues
or each section of this article which shall be found to have been
violated shall constitute a separate offense.
