This chapter shall be known and may be cited as the "Administrative Code of the Township of Robbinsville."
The purpose of this chapter shall be to establish departments, boards, commissions, authorities and committees; allocate the Township's functions, powers and duties among and within the departments; establish official relationships; prescribe standards and procedures for the conduct of the public business, pursuant to N.J.S.A. 40:69A-1 et seq. and any and all statutory provisions of the State of New Jersey applicable to the Township.
A. 
Terms defined. As used in this chapter, the following terms shall have the meanings indicated:
ADVICE AND CONSENT
The majority vote of a quorum of the Council, but in no case less than two affirmative votes if two is sufficient to grant advice and consent. If consent is not granted, the Mayor shall have the right to resubmit the matter to the Council.
CHARTER
The Mayor-Council Plan pursuant to the Optional Municipal Charter Law (OMCL), N.J.S.A. 40:69A-1 et seq, as amended and supplemented, and any and all statutory provisions of the State of New Jersey applicable to the Township.
CLERK
The Municipal Clerk appointed pursuant to the Charter and statutes of the State of New Jersey.
COUNCIL
The local legislative body of the municipality elected pursuant to the Charter and designated as the Municipal Council of the Township of Robbinsville.
DEPARTMENT
An organizational unit of the municipal government established by or pursuant to this chapter and headed by a director.
DIRECTOR
The head of a department appointed by the Mayor with the advice and consent of Council.
GENERAL LAW or LAW
Any law or provisions of law not inconsistent with the Optional Municipal Charter Law, N.J.S.A. 40:69A-1 et seq., heretofore or hereafter enacted, which is by its terms applicable or available to all municipalities, and the following additional laws, whether or not such additional laws are so applicable or available to all municipalities: legislation related to taxation, local courts, health, public authorities serving more than one municipality and municipalities in unsound financial conditions.
GOVERNING BODY
The Township Council and the Mayor as constituted under the Charter. Any administrative or executive functions assigned by general law to the governing body shall be exercised by the Mayor. Any legislative and investigative functions assigned by general law to the governing body shall be exercised by the Council.
MAYOR
The chief executive officer of the Township of Robbinsville exercising the executive powers of the Township as set forth in the Charter.
MUNICIPALITY
The Township of Robbinsville, in the County of Mercer, State of New Jersey.
ORDINANCE
All ordinances of the Township of Robbinsville in force and effect on the date of adoption pursuant to the Code of the Township of Robbinsville, County of Mercer, State of New Jersey, as amended, unless specifically repealed by this chapter, and all ordinances hereinafter adopted by the Council of the Township of Robbinsville. An ordinance shall also be defined as an act or regulation of the Council required to be reduced to writing and read at more than one meeting thereof and published, pursuant to N.J.S.A. 40:49-1 et seq.
PRESIDENT
The President of the Council.
QUORUM
A majority of the whole number of members of the Council.
RESOLUTION
Any act or regulation of the Council required to be reduced to writing, but which may be finally passed at the meeting at which it is introduced and which does not require action by the Mayor as a condition of approval for the exercise thereof.
ROLL CALL VOTES
The vote upon every motion, resolution or ordinance by yeas and nays as entered on the minutes of each meeting.
TOWNSHIP
The Township of Robbinsville, in the County of Mercer, in the State of New Jersey.
B. 
Word usage. For the purpose of this chapter and any other ordinance or resolution heretofore or hereafter adopted, except as the context may otherwise require:
(1) 
The present tense includes the past and future tenses, and the future tense includes the present.
(2) 
The singular number includes the plural, and the plural includes the singular.
(3) 
"Shall" is mandatory; "may" is permissive.
(4) 
The time within which an act is to be done shall be computed by excluding the first day and including the last day, and if the last day is a Saturday, Sunday or legal holiday, that day shall be excluded and the next following working day shall be the last day.
(5) 
"Writing" and "written" includes any printed, typed, written, computer-generated and any other mode of communication using paper or similar material which is in general use, including but not limited to data sheets, data processing cards, photographs, photographic negatives, photo records, tape recordings, wire recordings, transcripts of recordings, as well as legible handwriting.
(6) 
The feminine shall include the masculine. The masculine shall include the feminine.
