Pursuant to the Uniform Fire Safety Act (N.J.S.A. 52:27D-203) the New Jersey Uniform Fire Code shall be locally enforced in the Township.
The local enforcing agency shall be the Bureau of Fire Prevention, which shall consist of the Fire Official and/or the Chief of the Division of Fire.
The local enforcement agency shall enforce the Uniform Fire Safety Act and the codes/regulations adopted under it in all buildings, structures and premises within the established boundaries of the Township, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by § 122-2 shall carry out the periodic inspection of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
The local enforcing agency established by § 122-2 shall be a part of the Division of Fire of the Township. The local enforcing agency shall be under the direct supervision/control of the Fire Official and/or Chief of the Division of Fire.
A. 
Appointment of Fire Official. The local enforcing agency shall be under the direct supervision of the Fire Official, who shall be qualified pursuant to the Uniform Fire Code (N.J.A.C. 5:71-3.2 et seq.).
B. 
Term of office. The Fire Official shall serve under the direction of the Director of Public Safety and/or the Chief of the Division of Fire. The Fire Official may be removed for cause in accordance with law.
C. 
Inspectors and employees. Such inspectors and other employees as may be necessary in the local enforcing agency shall be appointed by the governing body upon the recommendation of the Chief of the Division of Fire and/or the Fire Official.
D. 
Removal from office. Inspectors and other employees of the enforcing agency shall be subject to removal by the governing body for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the appointing authority or a designated hearing officer.
Pursuant to N.J.S.A. 52:27D-206 and 52:27D-208 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement agency (or agencies) shall have the right to appeal to the Mercer County Construction Board of Appeals.
Inspections. In addition to the inspections required pursuant to the Uniform Fire Safety Act and the regulations of the Department of Community Affairs, all buildings, structures and uses within the Township of Robbinsville, except for owner-occupied one- and two-family dwelling units and dwelling units within two-family and multifamily dwellings, shall be inspected for compliance with the Uniform Fire Code not less than once per year. Fees therefor shall be provided in § 109-10C.
A. 
Fire hazard uses. Pursuant to the Uniform Fire Code of the State of New Jersey, certain enumerated types of uses are classified as fire hazard/life hazard uses for which the State of New Jersey collects annual registration fees. The State of New Jersey may seek information and assistance from the Robbinsville Township Fire Code Official and/or the Robbinsville Township Fire Prevention Bureau in establishing and/or collecting such fees.
B. 
Permits. The permit fees established by the Uniform Fire Code shall be collectible and payable to the Township on an annual basis.
