As used in this Article, unless the context
otherwise requires, the following terms shall have the meanings indicated:
The Town of Standish.
The Council of the Town of Standish as provided for by the
Town Charter.
The Town Manager of the Town of Standish.
The Town Manager shall be appointed by the Town
Council, pursuant to Secs. 203A and 301 of the Town Charter.
A.
The Town Manager shall perform such duties as are
required of the Manager by the Charter and by general statute. He/she
shall be the chief executive officer of the Town and shall supervise
the work of the several departments. He/she shall see that all laws
governing the Town are faithfully executed and require the faithful
performance of all administrative duties for which he/she is herein
made responsible.
B.
The Town Manager or his/her designate shall completely
oversee the administration of the Standish Town Hall, including but
not limited to the administration of personnel and the physical maintenance
and structure of the building and furnishings and equipment and of
all the space within and without the structure, including the grounds
thereof. The intent of this is to give the Manager or his/her designee
complete authority over the physical use of the facility and the people
working therein and provide that no department will purchase, arrange
or discontinue the use of any equipment, including office equipment
such as typewriters, calculators, furniture, etc., without authority
and approval from the Manager or his/her designee.
C.
The Town Manager shall:
(1)
Appoint and remove. Appoint, prescribe the duties
of and, when necessary for the good of the service, remove all officers
and employees of the Town, except those officers and employees appointed
or removed by the Town Council pursuant to the Charter, Sec. 203B,
C and D, except as otherwise provided herein and except as he/she
may authorize the head of a department or office to appoint and remove
subordinates in such department or office.
(2)
Appoint to acting capacity. Designate himself/herself
or some other officer or employee to perform the duties of any office
or position in the administrative service under his/her control which
is vacant or which lacks administration due to the absence or disability
of the incumbent. This subsection does not apply to those officers
or employees who are appointed or removed by the Town Council pursuant
to the Charter, Sec. 203B, C and D.
(3)
Annual report. Prepare and submit to the Council as
of the end of the fiscal year a complete report on the finances and
administrative activities of the Town for the preceding year and cause
such annual Town report to be published and made available to the
public as promptly as possible after the close of the fiscal year.
(4)
Budget report. Prepare the budget annually, submit
it to the Council and be responsible for its administration after
adoption.
(5)
Administrative Code. Prepare an Administrative Code,
submit it to the Council and be responsible for its administration
after adoption.
(6)
Departmental responsibilities. Prepare, with respect
to each commission, committee or board, a list of all procedural duties
and responsibilities of such agencies upon approval by the Council,
file the same with the Town Clerk and be responsible for the administration
thereof.
(7)
Assign according to classification. Assign any employee
of the Town to any department or branch thereof requiring services
appropriate to the classification or qualifications of the employee
so assigned.
(8)
Prescribe rules. Prescribe such rules and regulations
as he/she shall deem necessary or expedient for the conduct of administrative
agencies subject to his/her authority and revoke, suspend or amend
any rule or regulation of the administrative service by whomever under
his/her authority prescribed.
(9)
Investigate. Either by himself/herself or by an officer
or person designated for the purpose by him/her, investigate and examine
or inquire into the affairs or operation of any department, division,
bureau or office and, when so authorized by the Council, employ consultants
and professional counsel to aid in such investigations, examinations
or inquiries.
(10)
Town departments. Recommend the establishment of Town
departments considered essential to proper administration of the Town.
(11)
Overrule officials. Set aside any action taken by
a department head under his/her authority and supersede him/her in
the functions of his/her office.
(12)
Delegate duties. Direct any department, division or
bureau in time of emergency.
(13)
Appoint administrative committees. Designate from
the administrative service such committees and the officers thereof
as he/she shall find necessary for the proper consideration of administrative
problems. Such committees shall meet at the request of the Town Manager
and shall make such recommendations on matters referred to them as
they shall find necessary for the best interest of the Town.
(14)
Work with Council. Attend the meetings of the Council,
except when his/her removal is being considered, and keep the Council
advised of the financial condition and future needs of the Town and
make such recommendations as may seem to him/her desirable.
(15)
Public complaints. Maintain in his/her office a public
complaint service, to receive complaints of citizens relative to the
public service. All such complaints shall be taken in writing, signed
by the complainant, and transmitted in duplicate by the Town Manager
to the proper department for handling. The Town Manager shall follow
up all complaints which are not reported on by the department to which
referred as promptly as reasonably possible and necessary to ensure
adequate service to the public. A complete report on all complaints
shall be made by departments and one copy returned to the Town Manager
for filing. All complaints which, in the opinion of the Town Manager,
are not properly handled shall cause the Town Manager to issue such
additional orders or instructions or take action as he/she deems advisable.
A reply, oral or written, shall be made to every complainant as promptly
as reasonably possible. The spirit of this service shall be that all
complaints, whether any Town official may consider them reasonable
or unreasonable and regardless of whether they are courteously or
otherwise presented by any citizen of Standish, shall be courteously
and promptly investigated and replied to, with the purpose of correcting
where necessary and improving whenever possible the service rendered
to Standish citizens by municipal officers and employees. Consistent
with this spirit on formal complaints, Town officials shall make plain
by their demeanor that they welcome at all times informal suggestions
for the improvement of the service.
