This chapter is adopted in accordance with N.J.S.A. 40:48-2.46 to regulate the parking of vehicles in parking yards and parking places which are open to the public or to which the public is invited, whether maintained or operated separately or in conjunction with any business or enterprise, for the purpose of creating reserved parking spaces for the physically handicapped.
Said parking spaces shall prohibit parking in the designated areas except for those persons who have been issued special identification cards by the Division of Motor Vehicles. No other persons shall be permitted to park in the reserved parking space provided for the handicapped.

The following areas shall be designated as handicapped parking spaces in Saddle Brook for use by persons who have been issued special identification cards by the Division of Motor Vehicles. No other person shall be permitted to park in these spaces. Each space or group of spaces shall be identified with a clearly visible sign displaying the international symbol of access along with the following wording: "These Spaces Reserved For Physically Handicapped Drivers; Penalty: $100.00 fine; up to 90 days' community service for violation." Each space shall be 12 feet wide to allow room for persons in wheelchairs or on braces or crutches to get in and out of either side of an automobile onto a level, paved surface suitable for wheeling and walking. The designated areas are as follows:
A. 
All public buildings in the Township of Saddle Brook, whether owned, rented or occupied by a public agency or board.
B. 
All stores, whether retail or wholesale, no matter how described which are either open to the public or to which the public is invited.
C. 
All banks and any other type of business or activity, no matter how described, which is either open to the public or to which the public is invited.

Parking spaces shall be determined as follows: a minimum of 1% of the total number of parking spaces, but not less than two parking spaces, shall be provided in an area of the parking facility which is most accessible and approximate to the building or buildings which the facility serves. Such spaces, when possible, shall be located so that persons in wheelchairs or using braces or crutches are not compelled to wheel or walk behind parked cars, and, where applicable, curb ramps shall be provided to permit handicapped people access from the parking area to the sidewalk.

Any person, firm or corporation who or which shall be found guilty of a violation of this chapter shall be subject to a fine of $250 upon the first offense and a fine of $250 plus a maximum of 90 days community service for all subsequent offenses.
