A. 
It is the purpose of the TH-3 Townhouse Zone District to provide for the development and redevelopment needs of an area primarily occupied by industrial and commercial buildings east of North Midland Avenue and generally south of Route 46. The TH-3 Zone will provide for the customary needs of one-person households, larger families and senior citizens residing in medium density multifamily housing.
B. 
The following lands and premises shown and designated on the Tax Assessment Map of the Township of Saddle Brook shall be rezoned and included in this district for varied residential development inclusive of attached single-family residential dwellings, townhouses, multifamily residential dwellings, including housing for residents age 50 and older, and associated open space, which shall be permitted within the framework of a comprehensive integrated community design of which a minimum of 30% of such units shall be handicapped accessible:

No building or premises or part of a building shall be used, erected, constructed or altered which shall be arranged, intended or designed to be used for any purpose other than the following uses:
A. 
Single-family attached or semi-attached residential structures, including a variety of housing types such as duplexes, townhouses and senior citizens' housing.
B. 
Customary accessory uses.
Conditional uses shall be as follows:
A. 
Garden apartment dwellings.
B. 
Coin-operated laundries for the exclusive use of the residents.
C. 
Buildings to serve as meeting halls or clubrooms for nonprofit veterans or fraternal associations fully and legally chartered or organized under the laws of the State of New Jersey or the United States of America, but excluding collegiate fraternal organizations.
A. 
Permitted accessory uses shall be as follows:
(1) 
Garages to house residents' vehicles.
(2) 
Indoor and outdoor tennis courts subject to planted buffers and site plan approval.
(3) 
Accessory recreational uses customarily incidental to the permitted uses, such as a shuffleboard area, bocci courts and swimming pools.
B. 
Permitted accessory uses shall be solely for use of residents and their guests.
Any uses other than those uses permitted by §§ 206-9.2 through 206-9.4 of this Article shall be prohibited. Without in any way limiting the generality and prohibition of this section, nothing contained in this Article shall be construed to permit any of the following uses in any TH-3 Townhouse Zone:
A. 
Structures exceeding three stories or 38 feet in height, except as noted in the table in § 206-9.6.
B. 
Professional offices or home occupations.
C. 
Mid-rise and high-rise apartments.
D. 
Parking of trucks, trailers, campers and other recreational and commercial vehicles.
E. 
Parking of boats.
F. 
Commercial, wholesaling, warehousing and industrial uses.
Area and yard requirements for townhouses and accessory uses shall be as follows:
A. 
Minimum area townhouse tracts: 40,000 square feet.
B. 
Maximum tract coverage by structures: 35%.
C. 
Maximum impervious coverage: 75%.
D. 
Minimum width at street: 100 feet.
E. 
Minimum front yard setback: 25 feet.
F. 
Both side yards when abutting a TH-3 District use: 30 feet.
G. 
Both side yards abutting all other uses: 35 feet.
H. 
Minimum side yard setback, one side: 15 feet.
I. 
Corner lot minimum side yard setback: 20 feet.
J. 
Rear yard setback: 30 feet
K. 
Off-street parking spaces: 1.75 for every zero-bedroom unit, plus two for every other unit, plus one for every four units for guests; senior citizens complexes: one for every unit, plus one for every four units for guests.
L. 
Minimum landscaped area: 25%.
M. 
Maximum dwellings per acre: 15.
N. 
Minimum buffer requirements: A minimum buffer of 10 feet will be required, subject to reduction in a development application if suitable fencing is provided.
