It is the purpose of the AB Adult Business and Vape Shop Overlay District to supplement and not to abrogate or eliminate any provision of N.J.S.A. 2C:34-7. It is also the purpose of the AB Adult Business and Vape Shop Overlay District to designate certain areas for sexually oriented businesses, tattoo parlors and vape shops as conditional uses subject to all the provisions of N.J.S.A. 2C:34-7.
A sexually oriented business, a tattoo parlor and a vape shop shall be allowed as conditional uses in the AB Adult Business and Vape Shop Overlay District. These types of businesses are prohibited in any zoning district in the Township except as conditional uses in the AB Zone.
The sale, rental or display of obscene material shall be prohibited in the AB Adult Business Overlay District (as well as in all other zones in the Township of Saddle Brook).
The following standards shall apply as conditions to conditionally permitted sexually oriented businesses and tattoo parlors:
A. 
The minimum lot size shall be one acre.
B. 
The minimum lot width at the street line shall be 150 feet.
C. 
The minimum front, side and rear yards and the maximum lot coverage and building height shall be the same as required for permitted uses in the base zone being overlaid.
D. 
On-site parking shall be provided at a minimum rate of one space for each 200 square feet of gross floor area, and such parking shall be provided within 200 feet of the principal pedestrian entrance to the establishment.
E. 
Business signage shall be limited to wall-mounted signs mounted on the ground story front facade of the portion of the building enclosing the establishment and shall not exceed in area more than 10% of the first story wall area enclosing the establishment. In no case shall the total area of such signage exceed 40 square feet. Such signage shall comply with all other requirements of Article XIII.
F. 
No sexually oriented materials shall be visible from the exterior of any building.
G. 
Sexually oriented businesses shall not include any booths or other private areas for patrons of the establishment.
H. 
The use shall not include any live entertainment, nor shall any portion of any lot containing such a use include live entertainment.
I. 
No such conditional use shall be located within 1,000 feet or any existing sexually oriented business or any existing tattoo parlor.
J. 
Sexually oriented businesses and tattoo parlors shall not operate prior to 9:00 a.m. nor after 11:00 p.m. as provided by law.
K. 
No persons under the age of 18 years shall be permitted on the premises of a sexually oriented business or tattoo parlor, and a sign near or on the principal entrance door, visible at all times, shall state "No persons under 18 permitted."
The following standards shall apply as conditions to conditionally permitted vape shops:
A. 
No vape shop shall be located within 1,000 feet of the boundary of any parcel occupied by any of the following uses (as measured in a straight line from parcel boundary to parcel boundary):
(1) 
Public or private early childhood, elementary, middle or high school;
(2) 
Park;
(3) 
Public playground;
(4) 
Recreation (use), outdoor;
(5) 
Community center;
(6) 
Day-care center;
(7) 
Athletic facility, indoor and outdoor.
B. 
No vape shop shall be located within 600 feet of a site occupied by another vape shop, as measured in a straight line from parcel boundary to parcel boundary.
C. 
The hours of operation for a vape shop shall be no earlier than 6:00 a.m. and no later than 10:00 p.m., seven days per week.
