Pursuant to the Uniform Fire Safety Act, N.J.S.A. 52:27D-202, the New Jersey Uniform Fire Code shall be locally enforced in the Township of Springfield.
The local enforcing agency shall be the Fire Official of the Township of Springfield.

The Fire Official shall be appointed by the Township Council. In making this appointment, the Township Council shall make the appointment from among a list of recommendations, containing at least three names whenever possible, provided by a committee of three persons, known as the Council from the Volunteer Fire Companies, consisting of a representative designated by the Springfield Township Fire Company, a representative designated by the Juliustown Volunteer Fire Company and a representative designated by the Jacksonville Fire Company, Inc., who shall all be appointed as such representative for a term of one year.
The Fire Official shall serve for a term of one year. Any vacancy shall be filled for the unexpired term.
The Township Council shall appoint such inspectors and other employees as may be necessary in the local enforcing agency, upon the recommendation of the Council from the Volunteer Fire Companies.
The Fire Official, inspectors and other employees of the enforcing agency shall be subject to removal by the Township Council, upon the recommendation of the Chief of Police, for inefficiency or misconduct. The Fire Official, inspector or employee to be so removed shall be afforded an opportunity to be heard by the Township Council or a designated hearing officer.

The local enforcement agency shall enforce the Uniform Fire Code, and the codes and regulations adopted under it, in all buildings, structures and premises within the established boundaries of Springfield Township, other than owner-occupied one- and two-family dwellings and buildings owned or operated by the federal government, the State of New Jersey and interstate agencies, and shall fairly comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by § 99-2 shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.
A. 
Permit fees. The permit fees established by the Uniform Fire Code and set forth in Chapter 91, Fees, § 91-8, shall be charged by the Fire Official.
B. 
Additional fees. In addition to the fees required pursuant to that Act and the regulations of the Department of Community Affairs, the following additional fees shall be required:
(1) 
All buildings or portions thereof, other than life hazard uses or one- and two-family (R-3 use group) owner-occupied dwellings, shall be inspected on an annual basis. The fee for each inspection of each use shall be as set forth in Chapter 91, Fees, § 91-8. The fee is due and payable within 30 days of the required inspection.
Pursuant N.J.S.A. 52:27D-206 and 52:27D-208, any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals of Burlington County.
A. 
Pursuant to the authority of N.J.S.A. 52:27D-202, there is hereby adopted by reference and incorporated as fully as if set forth herein at length, the “2003 International Fire Code,” except such portions as are hereinafter deleted, modified or amended or which are in conflict with or preempted by the State Fire Safety Code, for the purpose of prescribing rules and regulations for the governing of conditions hazardous to life and property from fire and explosion.[1]

B. 
Three copies of such Code are on file in the office of the Township Clerk for the use of the public.
As used in the Fire Safety Code, the following words shall have the meanings indicated:
CHIEF OF THE FIRE DEPARTMENT; CHIEF OF THE FIRE PREVENTION BUREAU; FIRE OFFICIAL
The Fire Official and any of his/her duly designated inspectors.
JURISDICTION; MUNICIPALITY
The Township of Springfield.
The Fire Official shall have the power to modify any of the provisions of the code adopted by this chapter, subject to the approval of the Township Council, upon application in writing, by the owner or lessee, when it is just and reasonable and there are practical difficulties in the way of carrying out the strict letter of the code, provided that the spirit of the code shall be observed, public safety secured and substantial justice done. The particulars of such modification, when granted or allowed, and the decision of the Fire Official thereon, shall be entered upon the records of the Township Council and a signed copy shall be furnished to the applicant.
The Township Council and the Fire Official shall act as a committee to determine and specify, after giving affected persons an opportunity to be heard, any new materials, processes or occupancies which shall require permits in addition to those enumerated in the code. The Fire Official shall post such list in a conspicuous place in his/her office and distribute copies thereof to interested persons.
A. 
Permits. Under the Fire Prevention Code, permits shall be required for the following:
Acetylene generators
Ammunition
Automobile tire rebuilding plants
Automobile wrecking yards
Blasting agents
Bonfires
Bowling establishments
Calcium carbide storage
Cellulose nitrate motion picture film
Cellulose nitrate plastics
Combustible fibers
Combustible materials
Compressed gases
Containers for welding and cutting gases
Dipping operations, flammable finishes
Dry cleaning plants
Dust-producing materials
Explosives
Fireworks displays
Flammable finishes
Flammable or combustible liquids
Fruit ripening processes
Fumigation
Garages, repair
Hazardous chemicals
Junkyards
Liquefied petroleum gases
Lumberyards
Magnesium
Matches
Oil-burning equipment, commercial

B. 
Term; revocation. The permit shall be for a period of one year, unless revoked by the Fire Official following notice of violation of the Fire Prevention Code and the failure of the permittee to correct the violation. Permits shall not be transferable.
C. 
Fees.
(1) 
For each permit required by this chapter, the Fire Official shall collect the fees as set forth in Chapter 91, § 91-8.
(2) 
The permit fee shall be paid to the Fire Official at the time of application for the permit. All permit fees shall be paid over to the Township Treasurer by the Fire Official after (s)he has issued the permit for which the fee was paid.
(3) 
The above fees shall be in addition to the inspection fees required under the Uniform Fire Safety Code. If a permit is required a under the Uniform Fire Safety Code, only that permit fee shall required.
A. 
Smoking prohibited in certain areas. No person shall smoke or carry a lighted cigar, cigarette, pipe or match, or use any spark, flame or fire-producing device not specially authorized for use in such place by the Fire Official in any of the following places:
(1) 
Retail stores designed and arranged to accommodate more than 200 persons or in which more than 25 persons are employed.
(2) 
Elevators, regardless of capacity, in any public place.
(3) 
Beds in public lodging houses, hotels, motels, dormitories, nursing homes, children’s homes, rooming houses or apartments.
(4) 
Public theaters, motion picture houses or auditoriums where either motion pictures or stage productions are performed. This prohibition shall include the projection room or enclosure where any motion picture machine is operated or where motion picture film is stored.
(5) 
Dance floors of any cabarets, restaurants, nightclubs or other public place offering facilities for dancing.
B. 
Exceptions. The prohibition of smoking shall not apply to specially indicated smoking rooms, rest rooms, restaurants, executive offices or any other area which has been specifically approved by the Fire Official by written order to the person having control of the premises upon finding that the same is not dangerous to life or property.
C. 
Signs required. Every person, or his/her agent, having control of the premises upon which smoking or the carrying of lighted objects is prohibited under this section shall conspicuously display within the prohibited area a sign designating SMOKING PROHIBITED BY LAW. No signs shall be removed without the express written consent of the Fire Official.
A. 
Throwing on ground. No person shall throw any hot or burning substances or cigars, cigarettes, matches or ashes from any window, doorway or moving vehicle.
B. 
Discarding near flammable material. No person shall throw or place any hot or burning substances, such as those enumerated in Subsection A, in, upon or in close proximity to any combustible material or materials which are likely to cause damage as a result of the heat or cause fire or explosion.
To the extent that any term or provision of the within Fire Prevention Code conflicts with or otherwise affects the terms and enforcement of the State Uniform Construction Code or the State Uniform Fire Safety Code, the terms and enforcement of such state codes shall deemed controlling.
