This article is enacted pursuant to the authority of Chapter 365 of the Laws of 1976, which added a new Subparagraph (3) to Paragraph (d) of Subdivision 1 of § 10 of the Municipal Home Rule Law, as amended or changed, authorizing the Town of Irondequoit to adopt a local law which amends or supersedes any provision of Town Law § 23, as amended or changed, and Public Officers Law § 3, as amended or changed, in relation to the property, affairs or government of the Town of Irondequoit or in relation to any of the other enumerated subject matters in such § 10, unless there is a state legislative restriction on such amendment or supersession.
In order to permit the Town Board of the Town of Irondequoit greater latitude in selecting the most qualified individuals to hold the appointed offices of Commissioner of Public Works, Deputy Commissioner of Public Works, Superintendent of Highways and Deputy Superintendent of Highways, it is necessary that prospective applicants not be limited to residents of the Town of Irondequoit but shall still reside within the limits of Monroe County.

Town Law § 23, as amended or changed, and Public Officers Law § 3, as amended or changed, are hereby amended and superseded in their application to the Town of Irondequoit as follows: provisions of Public Officers Law § 3, as amended or changed, and Town Law § 23, as amended or changed, requiring a person to be a resident of the political subdivision or municipal corporation of the state for which he or she shall be chosen or which his or her official functions are required to be exercised, shall not prevent a person from holding the offices of Commissioner of Public Works, Deputy Commissioner of Public Works, Superintendent of Highways and Deputy Superintendent of Highways, provided that such person resides within Monroe County, New York.
