The Building Inspector for the Town of LaGrange shall serve as the Electrical
Inspector for the Town. Actual electrical inspections, to the extent required
under the New York State Uniform Fire Prevention and Building Code or the
local laws or ordinances of the Town Code, and in accordance with the federal,
state or local electrical substantive standards incorporated by those Codes,
shall be made, at the discretion of the Town Board, by such independent contractor(s)
as the Town Board shall annually designate to serve on a calendar-year basis.
Appointments of such contractor(s) for inspection services shall be made annually
by the Town Board. The cost or expense of such inspections and/or reinspections
by the appointed independent contractor(s) shall not be a charge against the
Town of LaGrange, but shall be a charge against the properties inspected or
reinspected by said independent contractor(s).
A.
It shall be the duty of the independent contractor(s)
annually designated by the Town Board, if any, to report to the Electrical
Inspector whose duty it shall be to enforce all provisions of this chapter,
all violations or deviations from or omissions of the electrical work requirements
of the New York State Uniform Fire Prevention and Building Code or any local
laws or ordinances of the Town Code pertaining thereto, and all state, federal
or local standards incorporated in said codes by reference.
B.
The independent contractor(s) annually designated by
the Town Board shall make inspections and reinspections of electrical installations
in and on properties in the Town of LaGrange upon the written request of the
Electrical Inspector, or as otherwise herein provided. The Electrical Inspector
is authorized to direct the independent contractor(s), and the independent
contractor(s) shall thereupon be authorized, to make inspections and reinspections
of the electrical wiring, installations, devices, appliances and equipment
in or on properties within the Town of LaGrange where it is deemed necessary
for the protection of life and property by the Electrical Inspector. In the
event of an emergency, the Electrical Inspector may orally authorize the independent
contractor(s) to make electrical inspection.
C.
It shall be the duty of the independent contractor(s)
to furnish written reports to the Electrical Inspector and, if requested by
the Electrical Inspector, to owners and/or lessees of property where defective
electrical installations and equipment are found upon inspection. Based upon
the reports of the independent contractor(s), the Electrical Inspector shall
issue certificates of compliance only when electrical installations and equipment
are in conformity with applicable standards mentioned hereinabove.
A.
It shall be a violation for any person, firm or corporation
to install or cause to be installed or to alter electrical wiring for light,
heat or power in or on properties within the Town of LaGrange until an application
for inspection has been filed with the Electrical Inspector.
B.
It shall be a violation for any person, firm or corporation
to connect or cause to be connected electrical wiring in or on properties
for light, heat or power to any source of electrical energy supply prior to
the issuance of a temporary certificate or a certificate of compliance by
the Electrical Inspector.
C.
Whenever the Electrical Inspector has reasonable grounds to believe that a violation of Subsections A and B of this section has occurred, he shall be authorized to issue a written stop order notifying the owner of the property, or the owner's agent, or the person performing the electrical work to suspend all work until the stop order has been rescinded. Such order and notice shall be in writing and shall state the conditions under which the work may be resumed, and may be served upon a person to whom it is directed either by delivering it personally to him, or by posting the same upon a conspicuous portion of the premises where the work is being undertaken and sending a copy of the notice by first-class mail. A failure to obey such a stop order shall constitute a separate violation under this chapter.
D.
Violations of this chapter shall be punishable by a fine
of not more than $1,000 or imprisonment not exceeding one year, or both. Each
day that an offense continues herein shall be a separate violation. Also,
appropriate actions or proceedings may be taken at law or in equity to prevent
continuation of unlawful electrical installation or use under this chapter,
and to restrain, correct or abate a violation or to prevent illegal occupancy
of a building, structure or premises which is the subject of violations. These
actions at law or in equity may be in addition to the penalties prescribed
in this subsection.
