The purpose of this article is to prevent any obstruction or interference with the use of all roads and highways within the Town of LaGrange for public travel; to prevent any obstruction interference with the construction, reconstruction or maintenance of such roads and highways; to facilitate the clearing and removal of snow and ice from such roads and highways; and to prevent any obstruction or interference with any operation of the Town Highway Department during public emergencies.
A. 
No vehicle may be parked and left unattended in the right-of-way of any public road or highway within the Town of LaGrange during the period from November 1 of each year to April 15 of the following year.
B. 
The Superintendent of Highways of the Town of LaGrange shall have the power to cause the immediate removal from the right-of-way of any public road or highway, or of any other public property of the Town, of any vehicle which obstructs or interferes with the use of such road or highway for public travel; or which obstructs or interferes with the construction, reconstruction or maintenance of such road or highway; or which obstructs or interferes with the clearing or removal of snow or ice from such road or highway during the period from November 1 of each year to April 15 of the following year; or which obstructs or interferes with any operation of the Town Highway Department during public emergencies.
For the purpose of this article, the following terms shall have the meanings indicated:
VEHICLE
Any motor vehicle, trailer or wheeled conveyance.
A. 
After the removal of any such vehicle, as provided herein, the Superintendent of Highways may store the same in a suitable place at the expense of the owner thereof. Such owner may redeem the same upon payment to the Town Clerk of the amount of expense actually and necessarily incurred in effecting such removal, such charges to be set forth on the prevailing fee schedule adopted by resolution of the Town Board and as such schedule is modified from time to time by resolution of the Town Board.

B. 
The Town Highway Superintendent shall, without unreasonable delay, report the removal and disposition of any such vehicle removed, as provided in this article, to the Town Clerk. It shall be the duty of the Town Clerk, to the extent reasonably possible, to notify the owner of such vehicle, by ordinary mail, of such removal and disposition and of the amount which will be required to redeem the same as of the date of such notice.
C. 
The redemption charges contained in this section are not in themselves intended as a penalty for the violation of this article and the payment of the same by the owner shall not be an alternative to the penalty provided under § 226-14 hereof.

A violation of this article is hereby declared to be an offense, and a person violating the same may, upon conviction, be fined by a fine not to exceed $250 or by imprisonment not to exceed 15 days, or by both such fine and imprisonment.

For purposes of enforcement of § 226-14 of this article, the Superintendent of Highways, and any Deputy Superintendent, any law enforcement agency that has jurisdiction in the Town of LaGrange, or their duly authorized representative, shall have the authority to issue appearance tickets under Article 150 of the Criminal Procedure Law.
