The rules and regulations herein set forth shall apply to all public water districts and public water supply systems which exist within the boundaries of the Town of LaGrange as well as those public water districts and public water supply systems which shall be hereafter established in the Town in the future.
A. 
All public water supplied in the Town of LaGrange shall be through a water meter of such form and type as approved by the Town of LaGrange Water Department or other duly designated agent of the Town of LaGrange.
B. 
All water meters that shall be used on all public water systems of the Town of LaGrange must be procured from the Town and shall be the property of the Town of LaGrange. They shall be set at the expense of the property owner in such location, position and manner as to be readily accessible for reading and repair and kept free from obstructions and shall be fully protected from freezing and damage at the property owner's expense. A suitable stopcock shall be placed in the service pipe near the inlet side of the meter. A penalty will be imposed when a meter is damaged by freezing or other cause which shall be a lien against the property. All meters shall be under the exclusive control of and subject to the inspection at all times of the Town Board or its duly authorized agent. All repairs to and replacement of meters shall be made by the Town Board or its agents at the expense of the owner.
C. 
All water passing through a meter will be charged for, whether used or wasted. Meters will be tested at the consumer's request. If the meter is found correct, the consumer shall bear the expense of the test. Meters will be considered correct if registering within 2%. If a meter goes out of order and fails to register correctly, the consumer will be charged the average daily consumption as shown by the meter when in working order.
D. 
No person shall in any way interfere or tamper with the water meter or the valves and fittings connected therewith. Any person violating the provisions of this rule shall forfeit, as a penalty for such violation, the sum of $250 for each violation.
E. 
All meters must be sealed. The seal may be broken only by the authorized agent of the Town Board. Should the seal be broken in any other manner, the property owner will be held responsible, and the Town Board reserves the right to order the meter removed for test at the expense of the property owner.
A. 
All water rates are payable quarterly, and the minimum rate shall be payable even though no water is consumed, so long as the service shall be considered as connected with the Town main unless shut off by authority of the Town at the curb box or otherwise at the request of the owner. The minimum rate shall be payable even though the water has been shut off when such discontinuation has been made by someone not authorized by the Town. The amount of the charges may increase or decrease by resolution of the Town Board.
B. 
The owner shall be obligated to pay the minimum charge as set by resolution of the Town Board each quarter, regardless of the consumption of water for each said quarter, provided that said owner is connected to the system at any time during the quarter.
C. 
In addition to any other fees or charges provided by law, the owner of any parcel of real property served by a public water system shall pay a quarterly rate for the consumption of water. Such rate shall be fixed by the Town Board by resolution annually or at such time as the Town Board shall deem it proper and necessary.
D. 
Such water rates shall be payable on the 30th day of every third month of each year, and for nonpayment shall be subject to the penalties hereinafter provided. Charges for water which will be payable on December 30, 1985, shall be determined by the previous water meter reading together with any arrearages irrespective of the date of the last preceding water meter reading. In the event that readings will cover a period in excess of three months, charges will be determined by the average charge for water for a three-month period. Such average shall be determined by the last readings of said water meter.
A. 
All water bills shall be due and payable within 30 days of the billing date. After 30 days from the billing date, a penalty equal to 10% of the amount remaining due shall be added to said bill. Any customer whose water bill is not paid after 45 days shall have his service disconnected. If this occurs, there shall be a charge for restoring service during normal business hours and a separate charge for restoring service after normal business hours. The amount of the charges shall be set forth on the prevailing fee schedule adopted by resolution of the Town Board and as such schedule is modified from time to time by resolution of the Town Board.

Said water charges shall constitute a lien upon the real properties served by the public water system, and such lien shall be prior and superior to every other lien or claim except the lien of an existing tax assessment, water rate, sewer rent or other lawful charge imposed by the Town.

F. 
Separate consideration and separate provisions of this article are required with respect to the Grandview Estates Water District in view of the fact that said district contains no water meters.
