The following words and terms, as used in this chapter, are
defined as follows:
A structure or use which is customarily associated with and
incidental to that of the main structure or use located on the same
premises.
A building containing three or more household dwelling units
and designed for and occupied exclusively by three or more families
living independently of each other.
Includes universities and other institutions for higher education
authorized to confer degrees.
Any unit subject to the provisions of Article 9-B of the
Real Property Law of the State of New York.
A group of rooms which are designed for residential occupancy
by a single family, providing housekeeping facilities for such family.
In determining the number of dwelling units within a structure, consideration
will be given to the separate use of or the provision made for cooking,
heating and sanitary facilities, whether installed or not; both the
actual use to which the dwelling is being put and the potential use
to which the dwelling might be put; and whether kitchen and bathroom
facilities and bedrooms are so located as to provide privacy if occupied
by an additional family.
One or more persons occupying a dwelling unit as a nonprofit
household unit.
The distance from the property line, in the case of a public
road, or from the easement boundary, in the case of a private road,
to the part of the structure nearest such property measured at right
angles to the highway or drive but not including cornices, unroofed
and unwalled terraces, entrance steps, chimneys or cantilevers that
extend two feet or less into the setback.
The vertical distance as measured from the average elevation
of the proposed finished grade at the front of a building or of a
structure to the highest point of the building or the structure, which
highest point shall include, but not be limited to, the highest or
topmost point of the roof, together with all towers, elevator penthouses,
signs, tanks, elevator or stair bulkheads, mechanical equipment, light
poles and light standards, except for poles or standards of a public
utility company.
The total area within the lot lines of a lot, excluding any
portion of a lot within a public highway.
The width of any lot measured at the minimum required front
setback line.
A store or shop providing personal, financial, technical or
repair services, assistance or advice to individual consumers, including
but not limited to:
Arts and crafts studios or stores.
Appliance repair and rental.
Banks, savings and loans, and credit unions.
Bicycle repair.
Barbershops and beauty shops.
Contractors' offices, without accessory storage.
Dressmakers and tailors.
Dry-cleaning or laundry pickup stations.
Laundromat.
Locksmiths.
Musical instrument repair.
Optical center.
Professional photographer's studios.
Shoe repair.
Furniture upholstering shops.
Watch repair.
Copy services.
Personal service establishments do not include, as either a
primary or accessory use, the sale, rental, storage, service or repair
of any motor vehicles, including automobiles, trucks, buses, trailers,
recreational vehicles and motorcycles, or any use listed separately
as allowed in a zone.
A structure or portion of a structure, used for the private,
noncommercial storage of motor vehicles, in and about which no business
or industry is conducted.
A pool in which no person other than the owner of the premises
on which it exists shall have any interest, right, license, permit
or right of use of any kind or nature whatsoever.
A structure or portion of a structure in which the sale or
maintenance or servicing of motor vehicles or any mechanical vehicle
is conducted or which is designed or used for the commercial storage
of motor vehicles.
The distance from the rear lot line to the part of the structure
nearest such lot line measured at right angles to the rear lot line,
but not including cornices, unroofed or unwalled terraces, entrance
steps, chimneys or cantilevers that extend two feet or less into the
minimum setback.
A regularly organized institution of learning, other than
a college, approved by the Education Department of the State of New
York and/or Board of Regents.
The distance from either side line of the lot to the part
of the structure nearest such side lot line measured at right angles
to the side lot line, but not including cornices, unroofed or unwalled
terraces, entrance steps, chimneys or cantilevers that extend two
feet or less into the minimum setback.
Any name, identification, description, display, illustration,
symbol, logo, statue or device, illuminated or nonilluminated, which
is visible from any public place, designed to advertise, identify
or convey information, including any landscaping employing the aforesaid,
and/or used for the purpose of directing the public's attention to
an object, product, service, place, activity, person, institution,
organization or business. Displays of merchandise in storefront windows
at regular mercantile establishments shall not be considered signs;
however, a false window or window box affixed to the exterior of a
structure is a sign.
A building containing one dwelling unit and designed for
and occupied exclusively by one family.
An assembly of materials, forming a construction framed of
component structural parts for occupancy or use, including buildings.
Any body of water or receptacle for water having a depth
at any point greater than two feet that is used or intended to be
used for swimming, bathing or wading, constructed, installed, moved
or maintained in or above the ground outside of any building, dwelling
or other structure.
Any structure, not permanently attached to the ground, which
is movable in its entirety.
A building containing two household dwelling units and designed
for and occupied exclusively by two families living independently
of each other.
A part of real property intended for any type of use or uses,
and with an exit to a public street or highway or to a common element
or elements leading to a public street or highway, and may include
such appurtenances as garage and other parking space, storage room,
balcony, terrace or patio.
The purpose or purposes for which any structure or premises
or any part thereof is occupied or, if unoccupied, for which they
may be occupied.
