A. 
Before the first day of October in each year, the Chairman of the Committee of Public Safety of the Board of Trustees shall recommend to the Board the number of taxicab licenses which should be granted for the ensuing year. Recommendations made in such report shall be based on the population of the village, the number of persons taking trains at the Scarsdale Station and the general condition of the taxicab service as determined by the Chairman of the Committee of Public Safety.
B. 
The Board of Trustees shall consider the report and recommendations of the Chairman of the Committee of Public Safety and, after a public hearing, upon notice published in an official newspaper of the village, shall determine, by resolution, the number of taxicabs needed to provide safe and adequate service. After adoption of such resolution, a notice containing a copy of the resolution shall be mailed by the Village Clerk, not later than the first day of December, to each owner of a taxicab which bears a village-issued license valid at the time of such adoption.
C. 
If the resolution by the Board of Trustees determines that an addition or reduction of licenses is needed, the Board shall guide the Village Manager in the issuance of licenses. Additional licenses shall be allocated as fairly as possible to qualified applicants, without regard to the filing dates of the applications. If a reduction in licenses is needed, the Village Manager shall allot such reduction proportionately, based upon the number of taxicabs licensed to each existing licensee. Each existing licensee shall be permitted to retain a license to operate at least one taxicab.
No person shall operate or permit a taxicab owned or controlled by such person to be operated regularly for hire upon the streets of the village unless a current and valid taxicab license, as provided herein, is in effect for said taxicab.
Taxicab licenses and renewal licenses shall be issued and valid effective the first day of January of each year and shall expire on December 31 following, unless sooner suspended or revoked.
For each taxicab license issued, the applicant shall pay a fee for an effective period of over six months or for an effective period of up to six months, such fee to be set by resolution of the Board of Trustees.[1]

Application for a taxicab license shall be made by the taxicab owner upon a form supplied by the Village Clerk, furnishing such information as the Village Manager shall require. Each such application shall be presented to the Village Clerk for filing.
A. 
If a license shall be defaced or changed in any respect, the licensee shall report this fact immediately to the Village Clerk or Village Manager, who may thereupon cancel the old license, which shall be surrendered by the licensee, and issue a new license.
B. 
Should any material changes occur in any of the facts or matters set forth in the taxicab license, such changes shall be immediately reported by the taxicab owner to the Village Clerk, who shall make a record of such changes in his office.
The Village Manager may, in his discretion, permit the license of any taxicab which has been sold or the control of which has been transferred to be assigned to and used by the new owner thereof, provided that the latter files a new license application and meets the requirements of this chapter in the same manner as if it were an original application. Such new owner shall pay a fee as set by resolution of the Board of Trustees[1] before the assignment of such license shall become effective.

If it is desired or becomes necessary for another taxicab to be substituted for a taxicab licensed hereunder before the expiration of the original taxicab license, the owner shall file such a request on a form supplied by the Village Clerk. The Village Clerk is hereby authorized, in his discretion, to permit such substitution. After an inspection and report has been made of such substituted taxicab as provided in § 272-30 of this chapter, the Village Manager may direct the Village Clerk to endorse upon the original license permission to transfer the license to such other taxicab.
A. 
The Board of Trustees may revoke or suspend a taxicab license at any time after a hearing. Any such suspension shall be for such period as such Board shall prescribe.
B. 
The Board may revoke or suspend such license if it finds that said taxicab has been used by the owners thereof or by any agent or employee of said owner for any of the following purposes:
(1) 
For any immoral or illegal business or purpose.
(2) 
For any statement in the application that is false.
(3) 
For violation of any provisions of this chapter.
(4) 
For violation of any provision of the Code of Scarsdale or of any other statute or law which is subject to a penalty equivalent to or more severe than that for a violation under the Penal Law of the State of New York or which is otherwise described as similar to or more severe than such a violation under the Penal Law of the State of New York.
C. 
If the Chief of Police or Village Manager shall at any time determine after an inspection as provided in § 272-30 of this chapter that a taxicab licensed under the provisions of this chapter is unsafe, unfit for the transportation of passengers, unclean or not of good appearance, he may temporarily suspend the license of such taxicab.
A card shall be issued to the owner of the taxicab, which card shall contain the name and address of the taxicab owner, the expiration date of the license, a statement that the applicant is licensed and the signature of the Village Clerk. Said card shall constitute the taxicab license and shall be impressed with the Seal of the village and shall at all times be kept conspicuously displayed along with the driver's license and a number to call if riders wish to make complaints.
License decals, provided by the Village Clerk, shall be affixed to the front bumper of said taxicab.
No taxicab license shall be issued until the application therefor has been approved by the Village Manager.
