The purpose and intent of this article shall be to preserve the public health and welfare by declaring and enforcing certain regulations on the feeding of waterfowl. The Borough recognizes that the feeding of waterfowl contributes to the concentration of such birds in areas frequented by the public, that such concentration is destructive to lawns, can create traffic hazards and that the resultant quantities of feces create public safety and health concerns on athletic fields and parks, make sidewalks slippery and reduces the aesthetic value of public property.
As used in this article, the following terms shall have the meanings indicated:
WATERFOWL
Includes members of any and all species of wild and domestic aquatic birds, including but not limited to ducks, geese and swan.
It shall be unlawful to provide feed, including but not limited to bread, corn and other grains, for waterfowl on public property. It shall be unlawful to provide feed, including but not limited to bread, corn and other grains, to any waterfowl on private property without the prior approval of the owner of such property.
It shall be the duty of the Borough of Downingtown Police Department to enforce the provisions of this article. A police officer observing a violation of this article in his or her presence may issue a citation for such violation. Any person, firm or entity that violates any provision of this article shall be subject to a fine of $25 for the first violation, $50 for the second violation and $100 for the third and subsequent violations. Each separate offense shall constitute a separate additional violation.
The effective date for this article shall be July 1, 2001.
