Disorderly conduct is hereby prohibited in the
Borough of Downingtown.
As used in this article, the following terms
shall have the meanings indicated:
The commission of any of the following acts:
The willful making or causing to be made of
any loud, boisterous and unseemly noise or disturbance or the engaging
in a fight or quarrel or the inciting of others to engage in a fight
or quarrel to the annoyance of the peaceable residents nearby or near
to any public highway, road, street, lane, alley, park, square or
common whereby the public peace is broken or disturbed or the traveling
public annoyed.
The willful and malicious blocking or obstructing
of a public highway, road, street, alley, sidewalk, park, square or
common whereby the orderly flow of pedestrian or vehicular traffic
is halted or impeded or the willful engaging in any act or conduct
or the persisting in any act or conduct knowing that such act or conduct
unreasonably halts or impedes the orderly flow of pedestrian or vehicular
traffic.
The using of language at or near a public street,
highway, road, alley, sidewalk, park, square or common which does
and is calculated only to annoy, harass, shock or embarrass the traveling
public or the peaceable residents nearby.
The doing of any of the following acts with
the intent to provoke a breach of the peace or whereby a breach of
the peace may be occasioned:
Using offensive, disorderly, threatening, abusive
or insulting language, conduct or behavior.
Acting in a manner as to annoy, disturb, interfere
with, obstruct or be offensive to others.
Congregating with others on a public highway,
road, street, alley, sidewalk, park, square or common and refusing
to move on when ordered by the police.
Nothing in this article shall be construed to
abrogate the rights of any person or group to the otherwise lawful
exercise of the rights of free speech and assembly.

Any person who shall violate this article shall,
upon conviction thereof, be sentenced to pay a fine of not more than
$600 and costs of prosecution, for each offense, and, in default of
the payment of such fine and costs, to imprisonment for not more than
30 days.
