As used in this chapter, the following terms shall have the meanings
indicated:
A shopping cart, basket or wagon or similar mechanical device used
to transport groceries or other items of personal, tangible property purchased
in a supermarket or other place of business in the Borough of Downingtown.
Any grocery store or other place of business engaged in selling items
of tangible personal property at retail or wholesale.
A.
All owners of public or private markets selling groceries
or other items of personal consumption shall prohibit the removal of carriers
from the store premises.
B.
It shall be unlawful for any shopping cart, basket, wagon
or similar carrier used to convey market products from any retail shopping
center to be removed from the premises of the vendor.
C.
It shall be unlawful for any person to remove any shopping
cart from the premises of the vendor from which it is removed or from the
premises of the owner of said cart.
All owners of private or public markets selling groceries or other items
of personal consumption, upon notification by the Borough of Downingtown that
carriers from said place of business are found on the public streets, highways,
bridges, streams or waters of the Borough of Downingtown, shall cause the
same to be immediately recaptured and returned to the premises aforesaid.

Any person, including any legal entity, who or which shall violate any
of the provisions of this chapter or who shall fail to comply with the provisions
hereof shall be guilty of a summary offense and, upon conviction thereof before
any District Justice, shall be liable to a fine of not more than $600 and
costs of prosecution, for each offense, and, in default of payment of such
fine and costs, to imprisonment in the county jail for a term not exceeding
30 days.
