The Board of Supervisors hereby adopts the following provisions with
respect to house numbering and identification of streets and roads in public
or private developments in the Township of Kidder.
The purpose of these regulations is to require a clear display of authorized
and assigned house or building numbers on every building fronting on any street,
public or private, in the Township of Kidder, together with identification
of all streets and roads in public or private developments in order to assist
the general public and emergency services, public and private, in identifying
any property in case of emergency or otherwise.
All residential, commercial, industrial or other structures erected
or to be erected within the Township of Kidder shall display identification
numbers as provided herein and in accordance with specifications provided
herein. All roads, streets, lanes or other thoroughfares in public or private
developments shall display identification names for each said street, roadway,
lane or other thoroughfare as required by this chapter.
The owner, occupant or lessee of each and every structure which now
fronts or which may hereafter front upon any public or private street within
the Township of Kidder who has been assigned a house number prior to the effective
date of this chapter shall, at his own expense and within 60 days after the
effective date of this chapter, cause the authorized and assigned number of
such structure to be permanently and conspicuously placed in accordance with
the specifications set forth herein. Any owner who is not assigned a number
prior to the effective date of this chapter shall, within 60 days after notice
of assignment of such number, comply with the requirements of this section.
The owner, developer, property owner association or other entity having ownership
and/or control or responsibility for maintenance of all streets, roads or
other thoroughfares within public or private developments shall, within 60
days after the effective date of this chapter, cause to be placed identifying
street signs at each intersection within the said development to insure that
each and every said street, lane, road or thoroughfare shall be properly marked
and identified with signs of a type approved, in advance, by the Township
of Kidder for identification signs on public roads within the Township of
Kidder.
House or building numbers shall be:
A.Â
In Arabic numerals.
B.Â
A minimum height of three inches for residential properties
and a minimum height of six inches for commercial and industrial properties.
C.Â
Mounted in a secure fashion to the front wall or porch
of the building so as to be clearly visible from the street.
D.Â
Sufficiently legible as to contrasting background, arrangement,
spacing and uniformity so as to be clearly visible from the street.
E.Â
At least 30 inches above ground level and so placed that
trees, shrubs and other obstructions do not block the line of sight of the
numbers from the street upon which the building fronts.
If numbers affixed to the front of the building would not be visible
from the street, regulations may be satisfied if the owner, occupant or lessee
shall provide the Arabic numbers, as required by these regulations, upon a
post, rod or other type of fixture of substantial nature or a mailbox at or
near the frontage with the same number affixed thereon and so located upon
the same so that the number may be conspicuous and visible from the street
upon which the building fronts. All such numbers must be on the same side
of the street as the building is situate. When the provisions of this section
have been complied with, the owner, occupant or lessee of the house or building
shall not be otherwise obligated to affix Arabic numbers to said house or
building and shall be permitted at his option to utilize cursive numbers or
no numbers at all upon the house or building.
A garden apartment at townhouse condominium complexes shall provide
such building and apartment numbers as are provided for in these regulations.
Any person who violates or permits a violation of this chapter shall,
upon being found liable therefor in a civil enforcement proceeding commenced
by the township before a District Justice, pay a fine of not more than $600,
plus all court costs, including reasonable attorney's fees, incurred by the
township in the enforcement of this chapter. No judgment shall be imposed
until the date of the determination of the violation by the District Justice.
If the defendant neither pays nor timely appeals the judgment, the township
may enforce the judgment pursuant to the applicable Rules of Civil Procedure.
Each day a violation exists shall constitute a separate offense. Further,
the appropriate officers or agents of the township are hereby authorized to
seek equitable relief, including injunction, to enforce compliance herewith.
