As used in this chapter, the following terms shall have the meanings
indicated:
Includes shotgun, air gun, air pistol, spring gun or pistol, rifles
and pistols of any caliber, or any implement which impels with force a pellet
of any kind.
Except as herein otherwise provided, it shall be unlawful and it is
hereby prohibited for any person or persons to fire or discharge any firearm
within the Township of Kidder, Carbon County, Pennsylvania, with the intent
to damage or destroy any real or personal property belonging to the Township
of Kidder, any public utility company or of any person, persons, firm or corporation,
at any time or place within the Township of Kidder, or to endanger the life
or limb of any person or persons within the Township of Kidder.
No person shall, except in defense of person or property, or on an approved
target range under adult supervision, fire or discharge any firearm within
the Township of Kidder.
Nothing herein contained shall prohibit the use of a firearm shot at
any time by anyone otherwise lawfully permitted to use the same, during the
official Pennsylvania hunting seasons (provided that said gun is not discharged
within 200 yards of any building), the use of any type of firearm on an approved
target ranger under adult supervision, or use of firearms by any person licensed
to carry such firearms for law enforcement purposes.
The Secretary of the Board of Supervisors is hereby authorized to issue
permits for outdoor target ranges after the inspection and approval of such
ranges by the Supervisors of Kidder Township. Such target range shall have
a natural earth backstop of the type and kind approved by the National Rifle
Association. Such permits shall be valid for a period of one year from the
date of issue, and the fee for such permit shall be set from time to time
by resolution of the Board of Supervisors, provided that such a permit once
issued may be renewed yearly thereafter for an additional yearly fee upon
the written certification of the owner that the target range is in the same
location and condition as the previous year. A target range located wholly
within a residence or a building used on a lot in connection with a residence
may be used in accordance with the terms of this chapter without complying
with the permit requirements of this chapter.
Any Township Constable or any police officer lawfully engaged in his
law enforcement duties within the Township of Kidder is hereby authorized
to seize and confiscate any firearm, as defined herein, which shall be fired
or discharged within the limits of the Township of Kidder in violation of
this chapter.
Any person who violates or permits a violation of this chapter shall,
upon conviction in a summary proceeding brought before a District Justice
under the Pennsylvania Rules of Criminal Procedure, be guilty of a summary
offense and shall be punishable by a fine of not more than $1,000, plus costs
of prosecution. In default of payment thereof, the defendant may be sentenced
to imprisonment for a term not exceeding 90 days. Each day or portion thereof
that such violation continues or is permitted to continue shall constitute
a separate offense, and each section of this chapter that is violated shall
also constitute a separate offense.
