The following rules and regulations are hereby established for the management and protection of parks and playgrounds located within the Borough of West Chester, hereinafter designated "the parks":
A. 
All Borough parks will be open from dawn to dusk and shall be closed from dusk to dawn. No person other than duly authorized law enforcement personnel are authorized to be in a Borough park from dusk until dawn.

B. 
No person shall injure, deface, remove, cut or damage any of the trees, plants, shrubs, turf, buildings, structures or fixtures therein, or any other property of the Borough located within the park.
C. 
No person shall dispose of any waste or garbage in the park except in receptacles designated for respective purposes. All persons using the park shall dispose of waste and garbage left by them in such proper receptacles.
D. 
Disorderly conduct by the public, such as intoxication, indecent language and/or excessive or amplified sound and noise, is not permitted within the park.
E. 
No person or organization shall hold any meeting or gathering assembled through advertisement of public notice or any gathering otherwise assembled composed of 25 or more persons within the limits of the park without first having made application to the Borough for a permit. Such permit shall indicate the spot in the park where such gathering or meeting shall be held, and such gathering shall not be held at any other spot within the park. The application for such permit shall be in the name of the person who will be responsible for seeing that all refuse left by the group shall be placed in proper containers or removed from the grounds before leaving the park. The application shall also state the sponsoring person(s) or organization(s), the approximate number of persons attending the event, the hours for which the event is scheduled, the equipment to be used and other pertinent information. The application for such permit shall be made at least 72 hours prior to the time of the event for which permission is being requested.
F. 
For all gatherings in which police security is deemed necessary by the Borough, or appropriate, such security must be paid for by the sponsor(s) of the gathering.
G. 
No motor vehicles of any kind are allowed within a park without formal written permission of the Borough.
H. 
All pets and animals must be restrained on a leash, and owners shall clean up after their pets.
I. 
No structure and/or tent shall be erected within a park without a permit.
J. 
There shall be no open fires or campfires. Cooking is allowed only in grills.
K. 
The possession and/or the use of alcoholic beverages or controlled substances are strictly prohibited as a violation of the law, and such contraband is subject to immediate confiscation.
L. 
No person other than a sworn police officer or other law enforcement officer engaged in the performance of his or her official duties shall discharge any firearm within the limits of any Borough park.

M. 
Playground equipment should be used only by children of the appropriate age for each piece, and with adult supervision.
N. 
No person shall set up any booth, table, stand or structure whatsoever within the limits of the park without a permit from the Borough.
O. 
No person shall be permitted to sleep in the parks at any time between dusk and dawn, and no person shall be permitted to sleep at any time on any equipment, furniture or facilities located in the parks.

Any person who shall be convicted of a violation of any of the provisions of this chapter before any District Justice shall be sentenced to pay a fine of not more than $1,000, together with costs of prosecution, or to imprisonment in the county jail for a term not to exceed 30 days, or both.
