A. 
In order to facilitate the movement of traffic and to combat the hazards of excessive snow and ice on the highways or portions of the highways named in § 104-82A of this article, the Mayor, in his discretion, may declare an emergency due to such hazards.
B. 
In order to facilitate the movement of traffic and to combat the hazards of excessive snow on the highways or portions of the highways named in § 104-82B of this article, when snow accumulations reach and/or exceed four inches on the highways or portions of the highways named in § 104-82B during any snowfall, parking is automatically prohibited and a snow emergency shall be deemed to exist.

A. 
After any such emergency shall have been declared in accordance § 104-79A, it shall be unlawful during the period of such emergency for any person to park a motor vehicle or tractor or to allow the same to remain parked on any highway or portion thereof named in § 104-82A of this article or to operate any motor vehicle or tractor on any such highway or portion thereof unless such motor vehicle or tractor shall be equipped with adequate equipment to provide sufficient traction to keep such motor vehicle or tractor in motion so that other traffic on such highways will not be blocked or impeded.
B. 
When a snow emergency is deemed to exist in accordance with § 104-79B, it shall be unlawful during the period of such emergency for any person to park a motor vehicle or tractor or to allow the same to remain parked on any highway or portion thereof named in § 104-82B of this article.

A. 
In order to assist the operators of motor vehicles and tractors in determining the highways affected by § 104-79A, the Director of Public Works and/or his designee shall place around the utility poles on the highways or portions thereof designated in § 104-82A signs reading as follows. The Mayor or the Chief of Police shall also, through radio, newspaper or other available media, disseminate information as to the existence of such an emergency.

B. 
Specific highways.
(1) 
In order to assist the operators of motor vehicles and tractors in determining the highways affected by § 104-79B, the Director of Public Works and/or his designee shall place a sign or signs along the highway, street or portions thereof designated in § 104-82B which shall state the following:

(2) 
The snow emergency existing on the highways, streets or portions thereof designated in § 104-82B shall be automatically discontinued at such time as the highways, streets or portions thereof have been cleared to the curb.

A. 
An owner or operator of any motor vehicle parked in violation of any provisions of this Article VII shall be issued a notice of violation and shall be ordered to pay a fine of $25, unless the fine is paid to the Borough of West Chester within 14 days of the issuance of such notice, in which case the fine amount shall be reduced to $15.
B. 
If the owner or operator of the motor vehicle fails to respond to the notice of violation as set forth in Subsection A above by payment of the fine within 14 days of issuance of such notice, the Borough shall send a warning letter requesting payment of the full fine of $25 within 10 days of the date of the letter. Should the owner or operator of the motor vehicle fail to respond to the letter by payment within the ten-day time frame, the Borough shall proceed with the issuance of a citation for the greater fine amount in accordance with the Pennsylvania Rules of Criminal Procedure. Upon conviction of the offense, the defendant shall be ordered to pay the applicable fine, the late fee of $10 and the costs of prosecution, and/or to be incarcerated in the county prison for not more than five days.

Upon the existence of a snow or ice emergency in accordance with the provisions of § 104-79A and/or § 104-79B, any vehicles remaining parked, stuck or stalled upon any of the highways, streets or portions thereof designated in § 104-82A and/or § 104-82B, as applicable, may be removed in accordance with the provisions of Article VIII of this chapter entitled "Removal and Impounding of Illegally Parked Vehicles."
