A. 
In accordance with and under the authority granted by MGL C. 111, § 31, the Georgetown Board of Health hereby adopts the following regulations as amended at a hearing held by the Board.

All other regulations of the Board of Health inconsistent with these regulations are repealed following the public hearing as of October 2, 1995.
Percolation and groundwater tests shall be conducted at the rate of one set of tests (two observation pits and two percolation tests) per lot, including those of a subdivision. The location of the tests are to be the proposed sites of the primary and reserve areas of the septic system. More tests may be required as deemed necessary by the Board of Health or its agent. Soil evaluations shall be conducted pursuant to Title V.
Applications for percolation and groundwater tests shall be submitted to the Board of Health or its agent any time of the year. Percolation tests and groundwater tests can be performed at any time of the year except under frozen ground conditions or any conditions determined by the agent to be unfavorable.
The following must be on file with the Board of Health before a test will be scheduled:
A. 
A completed application form.
B. 
A copy of the Assessor's map/or plot plan.
C. 
Proof of property ownership or a letter of authorization from property owner.
D. 
The number of lots to be tested and the number of tests requested (minimum of two deep observation pits and two percolation tests each lot).
E. 
The name of the engineer who will perform the tests.
F. 
The application fee as determined by the Board of Health.
A. 
If requested by the Health Agent or its representative, all lot lines must be staked, including those individual lots of a subdivision. The Board of Health shall be provided with surveyed location of percolation tests.
B. 
Although deep observation pits may be excavated prior to an agent's arrival, preparation of the percolation test hole must be done in the presence of the Board of Health representative or agent.
A. 
All test data, including test results, soil logs and accurate test locations must be submitted to the Board of Health by the engineer within 21 days after completion of the tests before the testing can be considered complete.
B. 
All submitted results and data shall be certified by a professional engineer registered in Massachusetts or by a registered sanitarian or person so authorized by the Georgetown Board of Health.
The Georgetown Board of Health reserves the right to adjust the groundwater elevation as required and deemed necessary.
Percolation test extensions may be granted by the Board of Health. The Board of Health, at its discretion, may require new deep hole and percolation tests to be performed if, in their opinion, there is a reason to do so. Examples are, but are not limited to: nonexisting records in Board of Health; topographical changes to the area; existing percolation tests and deep holes not in proposed system area.
So far as this Board of Health may provide, each section of these rules and regulations shall be construed as separate to the end that if any section, item, sentence, clause or phrase shall be held invalid for any reason, the remainder of these rules and regulations shall continue in full force and effect.
Any violation of the provisions of this chapter shall be punishable, upon conviction, by a fine as provided in MGL C. 111, § 31.
