The Board of Health of the Borough of Madison shall be composed of seven members.

A. 
Pursuant to the authority of N.J.S.A. 26:3-5, six members of the Board of Health shall be appointed for a term of four years by the Mayor upon the advice and consent of the Borough Council. In the event that the Mayor fails to make a nomination at least 15 days prior to the date of the second regular public meeting of the Council after a position becomes vacant or the Borough Council fails to confirm a nomination, then the appointment shall be made by the Borough Council by the vote of a majority of the members present at the meeting, provided that at least three affirmative votes shall be required, with the Mayor to have no vote thereon except in case of a tie. One member of the Board of Health shall be a Council member, appointed by the Borough Council, and the term of the appointment of such member shall be one year. In the event of a vacancy, the term of appointment shall be only for the unexpired term. The terms of office of the non-Council members shall be so arranged that the terms of no more than three members shall expire in any one year.

B. 
The terms of all existing Board members shall continue in accordance with their original appointment. The next vacancy occurring on the Board of Health after the effective date of this chapter shall be filled by the Council member to be appointed to the Board of Health, as hereinabove provided.
C. 
Pursuant to the authority of N.J.S.A. 26:3-5, and in conjunction with Chapter 205 of the Borough Code, Part III, Board of Health Legislation, the alternate members of the Board of Health shall be appointed by the Mayor with the advice and consent of the Council. In the event that the Mayor fails to make a nomination at least 15 days prior to the date of the second regular public meeting of the Council after an alternate member position becomes vacant or the Borough Council fails to confirm a nomination, then the appointment shall be made by the Borough Council by the vote of a majority of the members present at the meeting, provided that at least three affirmative votes shall be required, with the Mayor to have no vote thereon except in case of a tie. In the event of a vacancy, the term of appointment shall be only for the unexpired term.

The Board of Health shall meet at such times and places as shall be deemed expedient in regard to public health within said borough. The Board shall keep a record of its proceedings in a book suitable for that purpose, which shall be the property of the Mayor and Council. The Board shall make monthly reports of all proceedings to the Council.

The Board of Health shall have the power to adopt ordinances and codes as provided in N.J.S.A. 26:3-64 et seq.
