A.Â
The Mayor and Borough Council shall by resolution
adopt and amend from time to time personnel policies and procedures,
including rules concerning the hiring and termination of employees,
terms and conditions of employment, and regulations required to comply
with applicable federal and state employment-related law. The personnel
policies and procedures adopted pursuant to said resolution(s), including
those that may be contained within a Borough of Madison employee handbook
and/or Borough of Madison personnel policies and procedures manual,
shall be applicable to all officials, appointees, employees, prospective
employees, volunteers and independent contractors of the Board of
Health.
B.Â
The Borough Administrator shall be responsible for
implementing and enforcing the personnel practices adopted by ordinance
or resolution authorized pursuant to this section. If there is a conflict
between said personnel practices and any duly adopted and lawful collective
bargaining agreement, personnel services contract or federal or state
law, the terms and conditions of that contract or law shall prevail.
In all other cases, the practices adopted pursuant to this chapter
shall prevail.

During the year 2009 all officers and employees of the Board
of Health shall receive salaries within the salary ranges hereinafter
set forth. No officer or employee shall be entitled to retain any
portion of any fees collected in the performance of his/her duties
as a Board of Health officer or employee.

To the extent that anything contained in §§ 225-2 through 225-3 of this chapter is in direct conflict with the Borough of Madison Employee Handbook ("Handbook"), the Borough of Madison Personnel Policies and Procedures Manual ("Manual"), and/or Borough of Madison personnel policies and procedures as may be more fully set forth in or promulgated under the Code of the Borough of Madison, as amended ("Code"), the pertinent provisions of the Handbook, Manual and/or Code shall govern.

This chapter shall be retroactive January 1, 2007,
and shall continue in effect through December 31, 2007, unless sooner
amended.
