No person, business or association shall conduct an auction in the City of Saratoga Springs without first obtaining a license from the Commissioner of Accounts of said City and paying a license fee per auction.
A. 
Fees shall be established from time to time by the City Council for the licensure of auctions. A schedule of all such fees will be available for review in the Office of the City Clerk and on the City's web page.
B. 
Payment of the applicable fee under this section shall be due upon filing or renewal of the application.

No auction shall be conducted in the City of Saratoga Springs between the hours of 1:00 a.m. and 8:00 a.m., except for the public sale of horses.[1]

The provisions of this chapter shall not apply to sales of real estate.

Any person, firm or corporation violating any of the provisions of this chapter shall be subject to the penalties set forth in Chapter 1, General Provisions, Article III, of this Code.
