A. 
Whereas, the Townships of East Marlborough, Kennett, New Garden, Pennsbury and Pocopson and the Borough of Kennett Square, all municipalities located in Chester County, Pennsylvania, desire collectively to associated themselves together in a program of joint municipal equipment and manpower sharing and a program for the joint purchase of equipment, materials, supplies and services; and
B. 
Whereas, the power to associate themselves together for these purposes is granted by the Constitution of the Commonwealth of Pennsylvania, Article 9, Section 5, and by Act 180 of 1972, 53 P.S. § 481 et seq.,[1] relating to an intergovernmental cooperation agreement; and

C. 
Whereas, the Board of Supervisors of the Township of Pocopson, pursuant to the provisions of Section 485 of the aforesaid statute, is authorized to enter into an intergovernmental cooperation agreement and to delegate certain functions, powers and responsibilities to another governmental unit or political subdivision upon the passage of an ordinance by its governing body.
The Board of Supervisors hereby ordains to enter into the Kennett Area Region Mutual Cooperation Agreement ("agreement") between and among the Townships of East Marlborough, Kennett, New Garden, Pennsbury and Pocopson and the Borough of Kennett Square. The purpose of the agreement is to create joint programs. The agreement and amendments thereto may be adopted by resolution by the Board of Supervisors. The proper municipal officials are hereby authorized and directed to administer the programs that are described therein.
If any sentence, clause, section or part of this ordinance is for any reason found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect or impair any of the remaining provisions sentences, clauses, sections or parts of this ordinance. It is hereby declared as the intent of the Board of Supervisors that this ordinance would have been adopted had such unconstitutional, illegal or invalid sentence, clause, section or part thereof not been included herein.
All ordinances or parts of ordinances conflicting or inconsistent herewith are hereby repealed.
This ordinance will become effective five days from the date hereof.
