Pursuant to the authority granted by § 42.1-70 of the Code of Virginia, as amended, that there is hereby imposed and assessed in all courts located with Buchanan County, Virginia, as part of the cost incident to each civil action filed in said courts, the sum of $4, and the assessment shall be collected by the Clerk of the Court in which the action is filed and shall be remitted to the Treasurer of Buchanan County and held by such Treasurer, subject to disbursements by the Board of Supervisors for the acquisition of law books, law periodicals and computer systems for the establishment, use and maintenance of the Buchanan County Law Library, which shall be open for public use and for the payment of other disbursements necessary for the management of such library, as set forth by said statute. The Board authorizes the presiding Circuit Court Judge of Buchanan County to appoint a Law Librarian at a salary not to exceed $200 per month from the Law Library Fund. The Law Librarian shall timely update and maintain the Law Library. In the event that the Circuit Court Judge's secretary declines the Law Librarian position, the Board, upon the Judge's request, shall appoint an available county employee or constitutional officer or his employee as Law Librarian.
This article shall not apply to any action in which the Commonwealth of Virginia or any political subdivision of the commonwealth or the federal government is the party initiating such action and in which the costs are assessed against the commonwealth, political subdivision or federal government.
