No person shall use any building as a hotel, factory, theater, opera house, music or concert hall or other place of amusement, assembly hall, church, library, school, apartment house, charitable institution, multiple building or place of public assembly without first complying with the provisions hereof.
Any person desiring to use any building for any of the purposes specified in § 109-1 hereof shall file with the Building Inspector, in duplicate, a plan of such building showing:
A. 
The use to which the building is to be put.
B. 
The maximum number of persons who, under the proposed use, may be in the building at any one time.
C. 
The number and location of all exits.
D. 
The location and width of all aisles and passageways.
E. 
The number and location of all fire escapes.
If at any time the Building Inspector shall determine that any building being used for any of the purposes of § 109-1 hereof is inadequately fireproofed or is insufficiently supplied with fire escapes or that for any reason a fire hazard exists in a building or in the use to which it is being put or if any provision of this chapter is not complied with, he shall notify the owner and/or person using such building in writing to make such changes in the building or the use thereof as he shall consider necessary to comply with this chapter, and he may prohibit the use of such building until the changes specified shall have been made.
Any person who feels himself aggrieved by any action of the Building Inspector hereunder may appeal therefrom to the Board of Trustees. Such appeal shall be in writing, shall be filed with the Village Clerk and shall state fully the ground or grounds on which it is made. A copy shall be served upon the Building Inspector, who shall forthwith file with the Village Clerk all plans and papers in his possession relating thereto. Such person shall be entitled to a prompt hearing before the Board, and the Board may affirm, modify or reverse the action of the Building Inspector.
Every person using any building for the purpose specified in § 109-1 hereof shall, at all times when the same is in use, keep the aisles, passageways, exits and fire escapes free and clear of any and all encumbrances and obstructions whatsoever and shall not allow persons to sit or stand therein or in any way obstruct the same. Any person hindering or preventing compliance with the provisions of this section shall be a disorderly person, and his conduct shall be disorderly conduct.
Every person using any building for any of the purposes specified in § 109-1 hereof shall keep therein at all times in good working order fire extinguishers of a design approved by the National Board of Fire Underwriters. The number of such fire extinguishers to be kept and their location within such building shall be determined as follows: There shall be at least one extinguisher capable of reaching, without being moved from its regular station, any fire which may break out at any point within the building.
Every multiple-family dwelling containing three or more apartments or exceeding two stories in height shall be provided with fireproof outside stairways or fire escapes, and such stairways or fire escapes must be properly accessible to each apartment.
Every multiple-family dwelling shall be provided with a secondary means of egress from each apartment to the street or yard.
Every multiple-family dwelling shall have installed at least one light on each floor in each hall of said dwelling, which light shall remain burning during the hours from sunset to sunrise.
All fire escapes hereafter erected shall be constructed of noncombustible materials and of sufficient strength to safely sustain a superimposed load of 100 pounds per square foot. The owner or lessee of any building upon which a fire escape is erected shall keep same in good order and repair.
No person shall at any time place an encumbrance of any kind before or upon any fire escape. All fire escapes must be kept clear.
Any person using any building for any of the purposes specified in § 109-1 hereof shall keep therein at all times in good working order emergency lights approved by the Building Inspector as to number, design, style and location.

A. 
Any person committing an offense against any provision of this chapter shall, upon conviction thereof, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuation of an offense against the provisions of this chapter shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.
B. 
In addition or as an alternative to the above-provided penalties, the Board of Trustees may also maintain an action or proceeding in the name of the Village in a court of competent jurisdiction to compel compliance with or to restrain by injunction the violation of this chapter.
