The Board of Trustees of the Village of Babylon finds and declares that the provisions of this article are enacted to provide off-street employees permit parking facilities for those persons who are employed in businesses and commercial establishments located in the Village of Babylon and, in turn, make available more on-street parking spaces for operators of motor vehicles using the streets of the Village.
As used in this article, the following terms shall have the meanings indicated:
EMPLOYEE PERMIT PARKING AREA
A portion of a municipal parking field designated for employee permit parking only.
EMPLOYEE PERMIT PARKING SPACE
Any space within an employee permit parking area which is duly designated for the parking of a single vehicle by lines painted or otherwise durably marked on the surface located in said employee parking permit area.
Signs shall be of such a character as to inform readily an ordinarily observant person that parking in said area is not permitted unless the vehicle properly displays an employee parking permit sticker and the same is located on the vehicle as required by the Board of Trustees of the Village of Babylon.
Parking in areas of municipal parking fields designated as an employee permit parking area shall be limited to persons employed in the Village of Babylon where the vehicle shall have affixed thereto an employee parking permit sticker issued by the Village Clerk.
The identification sticker issued by the Village Clerk shall be affixed permanently and displayed in full view at all times on the inside of the left rear window of the vehicle. The license number on the identification sticker shall correspond to the number of the license plate of the vehicle on which it is displayed.
Employee parking permits are nontransferable and are valid for only one vehicle. Such permits shall automatically terminate when the holder thereof is no longer actually employed in the Village of Babylon.
In the event of damage or destruction to a sticker, a replacement must be obtained from the Village Clerk and the damaged sticker must be immediately replaced.
In the event of a change in registration or purchase of a different vehicle or leaving employment in the Village, said sticker must be surrendered immediately to the Village Clerk.
A permit for employee parking shall be used in strict compliance with the terms and conditions of this permit. Any violation by its holder of any terms or conditions shall constitute grounds for revocation by the Village Board or its authorized representatives.
Every person who shall park a vehicle in any areas or field described in this article, on which vehicle no identification sticker is displayed or the identification sticker is displayed improperly or the identification sticker has expired or the license number on the identification sticker does not correspond to the number on the license plate of the vehicle, shall be in violation of this article and, upon conviction, shall be punished by fine or imprisonment, or both, as provided in this article. Every vehicle parked in any area or field described in this article which does not display an identification sticker in accordance with this article may be towed away, impounded and stored, as provided in this article, at the cost and expense of the person violating this article as provided in this article.
The terms, conditions, regulations and fee upon which any identification sticker is issued by the Village Clerk shall be as authorized in resolutions adopted by the Board of Trustees from time to time. The Village Clerk will maintain a schedule of fees and regulations relating to identification stickers, their transfer, replacement and issue of additional stickers for vehicles in the same household.
Any person found guilty of a violation of any of the provisions of this article shall be punishable by a fine of not less than $15 nor more than $250 or imprisonment for not more than 15 days, or by both such fine and imprisonment.
