Editor's Note: This local law also provided for the repeal of former Ch. 64, Garbage, Rubbish and Refuse, which was comprised as follows: Art. I, Refuse Disposal and Collection, adopted 6-7-1954 as Ord. No. 149, as amended; Art. II, Accumulation of Refuse, adopted 10-10-1955 as Ord. No. 152, as amended; and Art. III, Bags and Dumpsters, adopted 5-14-1991 by resolution. See § 92-4.
As used in this chapter, the following terms shall have the meanings
indicated:
Household garbage, wastepaper, cardboard, garden refuse and all other
forms of material usually discarded in the operation of a residence except
the following:
A.
Trees, shrubbery or portions thereof.
B.
Stones, dirt and other forms of earth.
C.
Automobiles, motorcycles, bicycles, snowmobiles, lawn
or garden equipment, all-terrain vehicles and all other types of motor- or
manual-driven vehicles or parts of any of the foregoing.
D.
Large appliances.
E.
Construction or demolition debris and refuse.
F.
Toxic materials.
G.
Recyclables as so designated by any governmental authority.
H.
Any other items such as shall in the future be determined
by resolution of the Rhinebeck Village Board.
A.
All solid waste as described and to be disposed of in
the Village, except recyclables as hereinafter provided for otherwise, shall
be placed in plastic bags provided by the Village and purchased from the Village
Clerk according to a fee schedule adopted by the Village Board by resolution.
In the alternative, dumpsters may be utilized for such disposal in accordance
with rules, regulations and fees to be established by resolution of the Village
Board.
B.
The aforesaid plastic bags shall be placed at the curb
abutting their premises or at and in designated dumpsters no earlier than
6:00 p.m. on the day prior to a day which is designated by resolution of the
Village Board as a solid waste collection day.
C.
The aforesaid plastic bags may be placed in other usual refuse and garbage containers under the provisions of the foregoing Subsection B, and if so accomplished, such other containers must be removed from the curb no later than 8:00 a.m. on the day following any such collection day.
D.
Any person, firm or corporation so placing solid waste
for collection as hereinabove provided shall be responsible for and shall
clean up any of the same that shall become scattered by or resulting from
any cause other than conduct of Village employees.
E.
No person, firm or corporation shall hereafter dispose
of or deposit solid waste in a manner other than as herein provided.
F.
No person, firm or corporation who or which is not a
resident, business operator or real property owner within the Village of Rhinebeck
shall deposit anywhere in the Village of Rhinebeck for disposal any solid
waste or other refuse, debris, appliances, junk or personal property of any
kind, and none of the same arising from sources outside the Village shall
be so deposited.
G.
The owner or owners and the occupant or occupants of
each and every building or lot of ground with structures thereon within the
Village of Rhinebeck shall, at all times, keep said premises free from any
accumulations of solid waste, garbage, debris or other impure or offensive
matter or substance which may create or tend to create a nuisance or a danger
to health, and every such owner or occupant who shall receive a written or
printed notice from the Village Clerk, Building Inspector or any police officer
to remove the same shall do so within 24 hours after receipt of the notice.
Said notice shall be served personally or by certified mail, return receipt
requested. In the event of failure to comply with such notice, the Village
may enter upon the premises concerned and remove and dispose of any such prohibited
accumulation at the sole expense of said owner and/or occupant.
H.
The Village Board shall, by resolution and in accordance
with all applicable laws, rules and regulations, designate certain items of
solid waste to be recyclable glass, metals and plastic, and any such items
to be disposed of by any person, firm or corporation in the Village shall
be placed in special receptacles to be provided at the expense of the Village,
said receptacles to be placed, treated and removed in accordance with requirements
applicable to plastic bags. Other recyclable items, such as but not limited
to newspapers, inserts, magazines, paper bags and cardboard, shall be disposed
of by placing them at the curb on the days so allocated therefor by resolution
of the Village Board.
I.
This chapter shall be interpreted and enforced in accordance
with all laws, rules and regulations of the United States, the State of New
York and County of Dutchess as the same now exist or shall be hereafter enacted.
In the event that any provisions of this chapter shall be determined to be
unconstitutional, illegal or unenforceable under law, the remainder thereof
shall continue in full force and effect.
Any person, firm or corporation violating any of the provisions of this
chapter shall be liable, upon conviction, to a fine or penalty not exceeding
$250., plus the cost of cleanup for each offense, and each day that a violation
continues shall constitute a separate offense after notice of the existence
of the violation shall be given. In addition thereto, any violation of this
chapter shall constitute disorderly conduct, and every person, firm or corporation
violating the same shall be a disorderly person.
The provisions of "Garbage, Rubbish and Refuse" of the Code of the Village of Rhinebeck, New York, enacted and designated as Chapter 64, are hereby expressly repealed and superseded by this Local Law No. 2 of 1992.
