No person shall have in his possession any open
bottle or container containing liquor, beer, wine or other alcoholic
beverage with the intent of the possessor or another to consume said
beverage while such person is on any public highway, any public park,
public street, public parking area or in any vehicle or public place
within the Village of Round Lake, excepting those premises duly licensed
for sale and consumption of alcoholic beverages on the premises in
said Village.
An open bottle or open container in any vehicle
shall be presumptive evidence that the same is in possession of all
the occupants thereof and in violation hereof.
The foregoing restrictions shall not apply in
the event of a fair, picnic or other community gathering for which
special permission has been granted by the Board of Trustees and such
fair, picnic or gathering is in compliance with all other regulations
pertaining to the consumption of alcoholic beverages.
A violation of this chapter shall constitute
an offense punishable, for the first offense, by a fine not exceeding
$250 or by imprisonment not to exceed 15 days, or both; and for the
second and any subsequent offenses, by a fine not exceeding $500 or
by imprisonment not to exceed 30 days, or both.
