The following words, terms and phrases, when
used in this chapter, shall have the meanings ascribed to them in
this section, except where the context clearly indicates a different
meaning:
BOARD
The Zoning Board of Review of the Town.
DISPOSAL AREA
The site or lot upon which industrial waste, sludge or sewage
sludge is to be dumped or otherwise discharged or discarded.
LAND
Includes the words "marsh" and "water."
LOT
Includes the word "plot."
USED
Includes the term "designed, intended or arranged to be used."
The Town Engineer or the Building Inspector,
or both, may inspect any disposal area to ensure compliance with the
provisions of this chapter and the stipulations set by the Town Council
and Board.
The operator of a disposal area shall be required
to obtain a six-month noncancellable general liability insurance policy
or multi-peril policy for the benefit and protection of neighboring
property owners, and a cash bond in an amount to be determined by
the Town Council. The cash bond shall be held in an interest-bearing
escrow account in joint name between the operator of the disposal
area and the Town. The Town shall have possession of the account book,
and the funds therein shall not be relinquished or returned to the
party furnishing the bond until the Town Council has made a determination
that no damage to surrounding property owners' land has occurred,
and that the disposal area will no longer be in operation.
The operator of a disposal area shall permit
only industrial waste, sludge or sewage sludge which originates in
the Town to be disposed or discharged in the disposal area.
It shall be a violation of this chapter for
any operator of a disposal area to allow any person to dispose of
industrial waste, sludge or sewage sludge in a disposal area who has
not first obtained a license from the Town Council in accordance with
this chapter. Any violation of this section shall constitute sufficient
cause for the Town Council to revoke the operator's license.
