A. 
When the Township finds that a discharge of wastewater has taken place in violation of prohibitions or limitations of this Part 1, the Township may issue an order to cease and desist and may direct those persons not complying with such prohibitions, limits, requirements or provisions to:
(1) 
Comply forthwith.
(2) 
Comply in accordance with time schedule set forth by the Township in conjunction with MSA.
(3) 
Take appropriate remedial or preventive action in the event of a threatened violation.
B. 
A cease and desist order shall include a notice that the Township will discontinue service if the order is not complied with in the manner and within the time specified.
When the Township finds that a discharge of wastewater has taken place in violation of prohibitions or limitations prescribed in this Part I or wastewater source control requirements, effluent limitations or pretreatment standards, the Township may require the user to submit for approval, with such modification as it deems necessary, a detailed time schedule of specific actions which the user shall take in order to prevent or correct a violation of requirements. A user must comply with a schedule that has been approved by the Township to correct a violation.

A user affected by any decision, action or determination, including cease and desist orders, made by the Township in enforcing, interpreting or implementing the provisions of this Part 1 or in any permit issued hereunder may file with the Township Council of Byram Township a written request for a hearing for reconsideration within 10 days of such decision, action or determination, setting forth in detail the facts supporting the user's request for reconsideration.
B. 
The hearing shall be held within 45 days from the date of the written request. The applicant shall bear all costs and professional fees incurred relative to the hearing and, if required, shall post an escrow fee prior to the hearing. The Township Council shall render its decision within 30 days of the hearing.
Any person who violates any provision of this Part 1 or who discharges wastewater which causes pollution or who violates any cease and desist order, prohibition, effluent limitation, national standard of performance, pretreatment or toxicity standard shall be liable, civilly, to a penalty not to exceed $1,000 for each day on which such violation exists for each separate EDU.
Any person violating any of the provisions of this Part 1 shall become liable for any expense, loss, legal or other cost or damage occasioned by reason of such violation in addition to the penalties authorized in the preceding section.

In the case of a discharge of waste(s) in violation of Article IV of this Part I, entitled "Prohibited Discharges; Use of System," or § 201-56B in Article VII regarding grease interceptors, the property owner and/or sewer user shall be subject to the maximum permitted fines by this Part I (see § 201-100), reimbursement for costs per § 201-101, and must comply with the discharge requirements within 30 days of the violation.
