Any applicant wishing to subdivide land within the City of Cape May shall apply for and obtain the approval of the Planning Board in accordance with the following procedure. Minor subdivisions shall be a one-step process described herein. Major subdivisions shall be formally reviewed and approved in two stages with a complete preliminary and a complete final. Preliminary and final stages may not be combined by the applicant.
The applicant or his legally constituted agent shall appear at all regular meetings of the Planning Board whenever the application is being considered. Failure to appear shall give the Planning Board the right to postpone action on the application for that particular meeting or deny and dismiss the application without prejudice if the applicant or his agent's absence deprives the Planning Board of information necessary to make a decision. A legally constituted agent shall mean an attorney or a representative complying with the Board's power of attorney requirements. All corporations must be represented by an attorney.
