The Mayor and Council find that the leasing of motor scooters, motor bikes, motorized bicycles and motorcycles will greatly increase hazards to pedestrians and vehicular traffic in and around the streets and highways of the City, will precipitate noise so as to constitute a nuisance and detract from the peaceful enjoyment of the residents and visitors to the City, and will otherwise create problems involving the health, safety and welfare of the residents and visitors of the City.
It shall be unlawful to lease, bail or rent motor scooters, motor bikes, motorized bicycles, or motorcycles within the City.

The City Council of the City of Cape May finds that the unregulated operation of personal assistive mobility devices more commonly known as "Segways" as defined by N.J.S.A. 39:4-14.10(1)(a) within the City is a hazard to pedestrians and vehicular traffic in and around the streets, highways, and sidewalks of the City so as to constitute a nuisance and detract from the peaceful enjoyment of the residents and visitors to the City, and will otherwise create unnecessary risks involving the health, safety and welfare of the residents and visitors of the City.
It shall be unlawful to engage in the business of leasing or renting Segways for use upon any public streets, highways, sidewalks or any other public property within the City.
The operation of Segways is permitted within the City; provided, however, that the operation of a Segway by any person within the City shall be strictly limited to designated bicycle paths and private property. The operation of Segways upon any public streets, highways, sidewalks or any other public property within the City is strictly prohibited.
