Whenever a term is used in this chapter which is defined in N.J.S.A. 40:55D-1 et seq., such term is intended to have the meaning set forth in the definition of such term found in said statute, unless a contrary intention is clearly expressed from the context of this chapter.
All sections of the Zoning Ordinance or any other ordinance of the Borough of Lavallette which contains provisions contrary to the provisions of this chapter shall be and are hereby repealed, but only to the extent of such inconsistency.
Pursuant to the provisions of Section 81 of Chapter 291 of the Public Laws of New Jersey 1975 and Chapter 115 of the Public Laws of New Jersey 1976, the substantive provisions of Chapter 90, Zoning, and Chapter 57, Subdivision of Land, of the Code of the Borough of Lavallette shall continue in full force and effect until February 1, 1978, or until the Borough exercises the authority delegated by Chapter 291 of the Laws of 1975 to regulate development, whichever occurs first. Three copies of the text of the ordinances contained in Chapters 90 and 57 referred to in this section are on file in the office of the Borough Clerk and are available for public inspection until final action is taken on this chapter effectuating the readoption thereof.
All applications for development filed prior to the effective date of this chapter may be continued, but any appeals arising out of decisions made on any such application shall be governed by the provisions of Article III of this chapter.
This chapter shall be known and may be cited as the “Land Use Procedures Ordinance of the Borough of Lavallette.”
This chapter shall take effect on January 1, 1977.
Immediately upon adoption of this chapter, the Municipal Clerk shall file a copy of this chapter with the County Planning Board as required by law. The Clerk shall also file with said County Planning Board copies of all other ordinances of the municipality relating to land use, such as the Subdivision, Zoning and Site Plan Review Ordinances.
