There is hereby established a program for the municipal collection of garbage from all residences and commercial and institutional establishments, and bulky waste collection from residences within the Borough of Lavallette. The Borough Council shall annually, by resolution, establish a cleanup week or weeks for residential properties.
The Borough Council shall annually, or more frequently as necessary, by resolution, establish rules, regulations, and fees for the disposal of garbage, trash, bulky waste and the annual cleanup week and such other matters as are required to implement this chapter. Failure to conform to such regulations shall be deemed a violation of this chapter.
A. 
All garbage shall be placed in dark-colored, heavy-gauge plastic bags or metal, plastic or vinyl containers that are designed for such purpose with handles and a tight lid. The container shall be no more than 50 gallons in volume. The lid may not be attached to the container in such a manner, such as tied with a rope, string or cord, as to cause a hazard for municipal collection personnel. No cardboard boxes may be used in place of dark-colored, heavy-gauge plastic bags or metal, plastic or vinyl containers. In the event that garbage or refuse is placed in a paper or plywood drum, keg, barrel, cloth bag or similar container, such container will be disposed of as rubbish because it is not an approved container, and use of such container may result in a violation of this chapter.

B. 
Containers for the storage of garbage and trash shall not be stored forward of the front building line (and side building line on corner lots in the Business District) of the premises unless they are off of the sidewalk and completely obscured from public view.
C. 
Containers shall be kept as sanitary as possible in view of the use to which they are put and shall be cleaned as necessary.
A. 
Garbage placed for municipal collection shall not contain any of the designated recyclable materials. See § 55-17 of this chapter for the regulations regarding preparation of such materials.
B. 
The Borough shall not collect materials resulting from a demolition, repair, excavation, construction, renovation or similar activity performed on buildings or structures, including, but not limited to, plaster, mortar, lumber, roofing materials and other similar materials. The person, firm or corporation obtaining a construction permit shall be responsible for removing construction debris from the job site. If any person, firm or corporation places construction debris for curbside collection, a stop-work order shall be issued by the municipality, and no work shall continue until the construction debris has been removed by the person, firm or corporation to whom the construction permit was issued.
C. 
The Borough shall not collect any industrial or hazardous waste or industrial or commercial equipment.
D. 
All garbage shall be thoroughly dry of all liquids. If a metal, plastic or vinyl container is used for disposal, any wet garbage shall be wrapped securely in dark-colored, heavy-gauge plastic bags and placed in the container.
E. 
All broken window or plate glass or similarly dangerous material shall be placed in a secure container or wrapping to facilitate safe loading of the broken glass or other dangerous material.
F. 
Filled containers or dark-colored, heavy-gauge plastic bags shall not exceed 40 pounds in weight nor exceed the capacity of the container.
G. 
Nothing of a volatile or explosive matter, either in solid, liquid or gaseous form, or any hazardous material which could expose the collector to health or safety risks, shall be set out for collection either by itself or in connection with other garbage.
H. 
No property shall be used for the storage of garbage or trash from any other site, except that commercial establishments located in the Business District may store trash and garbage on an adjoining site, provided that storage is limited to an adequately sized, self-contained unit that is completely obscured from public view and at least 25 feet from any residential property.
I. 
No municipal employee shall collect any garbage, trash, or other refuse unless and until such items are prepared for municipal collection and disposal as directed in Subsections A through H above. Municipal employees who note violations to this chapter during their collection duties shall notify the Police Department and/or Code Enforcement Officer of any such violations.
A. 
Each plastic or metal container, including bags as specified in this chapter, shall be placed for collection immediately adjacent to the inside of the curbline.
B. 
Any items that are placed near the curbline on collection days shall be assumed to be placed for collection.
C. 
Trash and garbage may not be placed near the curbline in front of the property on which it is generated prior to 7:00 p.m. of the day before the designated collection day.
D. 
Owners of rental properties shall be responsible for posting collection schedules for their tenants. Where tenant changes occur, owners shall be responsible for disposal of accumulated garbage, trash and/or recyclable materials. Under no circumstances shall owners allow garbage or trash to remain at the curbside over a weekend.
E. 
Empty containers must be removed from the curbline no later than 6:00 p.m. on the day of the pickup.
Disposal of household garbage or trash in public litter receptacles is prohibited. Persons found doing so shall be in violation of this chapter.
A. 
The Borough Council shall from time to time, by resolution, establish a fee schedule and a schedule of dates for the collection of bulky solid waste items from residential property by the Department of Public Works. The fee is specifically to cover the cost of the service of picking up the item and the ultimate transportation and disposal of same.

B. 
Prior to any bulk waste/trash being placed at curbside, the residential property owner or occupant of the premises disposing of such item shall pay the disposal charge to the Borough of Lavallette. Upon the Borough receiving payment of the collection charges the Department of Public Works shall schedule the trash for pickup.
C. 
Bulk trash items shall only be placed at the curbline for municipal collection within 72 hours before the scheduled collection day.
D. 
In the event that bulk items are left at the curbline without the disposal fee being paid, municipal employees may collect such items and the Borough shall charge the disposal fee to the owner of the property in front of which the bulk item(s) was left. If said disposal fee shall remain unpaid for 30 days, the amount of said disposal, and the property owner to whom notice of the fee is sent shall not dispute said fee, the fee shall become a lien upon the above-referenced property.
