The following charges shall be made for water supplied by the Borough of Lavallette:
A. 
Capital surcharge. Each water user shall pay an annual capital surcharge of $160.00 per unit. The capital surcharge shall be billed in advance on a quarter-annual basis. A "unit" shall be defined as follows:

(1) 
Residential unit.
(a) 
Each single-family residential dwelling.
(b) 
Each residential dwelling unit in a multiple-family structure and each residential dwelling unit being serviced by a common meter.
(2) 
Nonresidential unit. Each nonresidential user having estimated or actual water consumption for the year prior to the billing period of 72,000 gallons or less. If the estimated or actual usage is in excess of 72,000 gallons per year, the number of units shall be determined by dividing the actual or estimated usage by 72,000 gallons and the number of units shall be a quotient thereof rounded to the next highest whole number.
B. 
Water usage charge.

The minimum quarterly charge shall be as follows:

(2) 
Excess usage charge. The charge for water usage in excess of minimum quarterly allowance shall be $3 per 1,000 gallons or part thereof. The excess usage charge shall be billed in the quarter following the actual usage.
(3) 
Residential units utilizing a common service line.
(a) 
Each residential unit utilizing a common service line with other units shall be billed a minimum quarterly charge.
(b) 
The common service line to the units shall be metered and be billed $3 per 1,000 or part thereof for actual water usage in excess of 5,000 gallons per quarter times the number of units connected to the common service line.
(c) 
The residential unit owners utilizing the common service line shall be required to designate an association or entity to which the charges shall be billed; provided, however, that each unit owner shall remain responsible for the payment of such charges.
C. 
Private fire protection service. Each property being supplied with water for fire protection or suppression devices shall be charged the following quarterly use charges for each lot, as shown on the Tax Map of the Borough of Lavallette, on which such property is located:

(2) 
Water use. No charge shall be made for water used for extinguishing fires. Water shall not be used for any purpose other than fire protection or suppression.
D. 
Fire Hydrant. The charge for a fire hydrant shall be $250 for each hydrant per year.

E. 
Water rates for construction use. The following charges shall be made to any person using water during the course of construction:

(1) 
Hydrant use: $50 per day, plus $3 per 1,000 gallons, or part thereof, of water used.
(2) 
Spigot use: $25 for each spigot used during the construction period.
F. 
Water taps.
(1) 
The minimum size of a water tap for residential and nonresidential user shall be one inch.
(2) 
The charge for the installation of a water tap shall be as follows:

G. 
Connection or disconnection of the municipal water supply.
(1) 
Any user may request the Superintendent of Public Works to connect or disconnect an existing water supply service line for a temporary or seasonal period. There shall be a turn-off fee of $20 and a turn-on fee of $20. The property owner or authorized person requesting connection or disconnection must be present during the connection or disconnection process.
(2) 
Any user may request the Superintendent of Public Works to permanently disconnect an existing water supply service line from the water main. There shall be a charge of $250 for this service.
(3) 
If the water supply service line is being disconnected for a period in excess of 10 days, the owner shall have the option of requesting the municipality to disconnect and store the meter. There shall be no charge for storage of the water meter by the municipality.
(4) 
Requests for connection or disconnection.
(a) 
All requests for temporary or seasonal disconnection or reconnection of the municipal water service supply shall be made upon 72 hours' prior notice to the Superintendent of Public Works. This work will be accomplished by the Borough on weekdays during normal business hours.
(b) 
All requests for new connection or permanent disconnection of the municipal water supply line shall be made to the Superintendent of Public Works. This work shall be accomplished by the Borough within 30 days of the request being made to the Superintendent of Public Works.
(5) 
No person other than an employee of the Borough of Lavallette shall be permitted to turn on or turn off the water supply service lines at the curb box. If any person, other than an employee of the Borough of Lavallette, attempts to turn on or turn off the municipal water supply service lines, said person shall be responsible for all damages to the water supply service lines and related equipment, including but not limited to the cost of labor and materials required to correct said damage. The Superintendent of Public Works shall be charged with the responsibility of determining the dollar amount of damage to the municipal water system.
Bills for the capital surcharge and minimum quarterly charges shall be issued in advance on a quarter-annual basis. Bills for excess water usage charges shall be issued on a quarter-annual basis in the quarter following the actual water usage. All water charges shall be due and payable within 30 days of the billing date. In the event that any charges are not paid within 30 days of the billing date, then said charges will be considered delinquent, and water services to the customer having a delinquent account can be discontinued by the Borough upon written notice to the property owner notifying of the proposed discontinuance and stating the reasons for the same. Said notice is required by and shall be given pursuant to N.J.S.A 40A:31-12. Interest at the rate of 18% per annum shall be charged to all delinquent accounts.
