The short-form title by which this chapter,
its supplements and amendments shall be known is the “Zoning
Ordinance of the Borough of Lavallette, New Jersey.”
It is the intent and purpose of this act to:
A.
Encourage the most appropriate use and development
of all lands in Lavallette in a manner which will promote public health,
safety, morals and general welfare.
B.
Secure safety from fire, flood, panic and other natural
and man-made disasters.
C.
Provide adequate light, air and open space.
D.
Lessen overcrowding of land.
E.
Promote the establishment of appropriate population
densities and concentrations that will contribute to the well-being
of persons and neighborhoods in the community and preservation of
the environment.
F.
Encourage the appropriate and efficient expenditures
of public funds by the coordination of public development with land
use policies.
G.
Provide sufficient space in appropriate locations
for a variety of residential, recreational, commercial and industrial
uses and open space, both public and private, according to their respective
environmental requirements in order to meet the needs of all Lavallette
citizens.
H.
Promote a desirable visual environment through creative
development techniques and good civic design and arrangements.
I.
Promote the conservation of open space and valuable
natural resources and to prevent urban sprawl and degradation of the
environment through improper use of land.
J.
Regulate the height, design, appearance and size of
buildings and other structures; the percentage of the area of the
lot that may be occupied; the size of yards, courts and other open
spaces; and the location and the use of buildings, structures and
land for trade, industry, residences or other purposes, towards the
end of promoting all of the aforesaid purposes.
A.
This chapter shall be liberally construed in the light
most favorable to the zoning scheme and welfare of the community as
a whole.
B.
The provisions of this chapter shall be interpreted,
construed and applied as the minimum requirements for the promotion
of the public health, safety, comfort, convenience and general welfare.
It is not intended by this chapter to repeal, abrogate, annul or in
any way to impair or interfere with any existing provisions of law
or ordinance or any rules, regulations or permits previously adopted
or issued or which shall be adopted pursuant to law relating to the
use of buildings or premises except as expressly provided herein,
nor is it intended by this chapter to interfere with or abrogate or
annul any easements, covenants or other agreements between parties;
provided, however, that where this chapter imposes a greater restriction
upon the height of buildings or the use of buildings or requires larger
yards, courts or other spaces than are imposed or required by such
existing provisions of the law or ordinance, or by such rules, regulations
or permits or by such easements, covenants or agreements, the provisions
of this chapter shall control.
