There shall be in and for the Borough of Mendham a Board of Health in accordance with the provisions of the act of the Legislature of New Jersey entitled "An Act to Establish in this State Boards of Health and a Bureau of Vital Statistics and to Define their Respective Powers and Duties," approved March 31, 1887, and the several supplements thereto.[1]

A. 
The Board of Health shall consist of five members. All members of said Board hereafter appointed shall be appointed by the Council and shall hold said office for three years, except in case of vacancies, which vacancies shall be filled for the unexpired term.
B. 
The Council may appoint two alternate members. Alternate members shall be designated at the time of appointment as "Alternate No. 1" and "Alternate No. 2." The terms of the alternate members shall be for two years, except that the terms of the alternate members first appointed shall be two years for Alternate No. 1 and one year for Alternate No. 2 so that the term of not more than one alternate member shall expire in any one year. A vacancy occurring otherwise than by expiration of term shall be filled by the Council for the unexpired term only.
C. 
An alternate member shall not be permitted to act on any matter in which he has either directly or indirectly any personal or financial interest. An alternate member may, after public hearing if he requests one, be removed by the governing body for cause.
D. 
An alternate member may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an alternate member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall vote first.
Said Board of Health shall adopt rules and regulations for its own government and shall elect a President from among its own members.
Said local Board of Health shall appoint a local Registrar of Vital Statistics, Secretary and Sanitary Inspector, who may be the same person, and a Plumbing Inspector, and may appoint such other officers or assistants as it may deem necessary. The term of office of such local Registrar shall be three years and until his or her successor has been appointed and qualified; and any vacancy occurring in such office shall be filled for the unexpired term only. All appointees of said Board shall be governed by the rules of said Board and be subject to all laws, rules and regulations governing such officers, and they may be removed for cause by said Board. The Sanitary Inspector shall promptly report to the local Board of Health every violation of the health ordinances[1] of the borough coming to his or her view or knowledge.

The Board of Health shall not contract any debt or debts of any kind beyond the amount of the appropriation made for its use by the Borough Council.
