It shall be unlawful for any person or persons,
firm or corporation to own, keep or harbor any domestic animals or
fowl, except cats and dogs, within the limits of the Borough of Mendham
unless a written license therefor is first had and obtained from the
Clerk of said Borough of Mendham.

Any person desiring a license to own, keep or
harbor any domestic animals or fowl, except cats and dogs, shall make
application to the Clerk of the Borough of Mendham for a license,
and the issuance of said license shall be based upon the suitability
of the premises housing the animals and fowl and subject to the rules
and regulations as hereinafter outlined.
There shall be no fee for such license, and
such license shall run for a period of one year from the date of issue.
The licensee shall comply with the following
rules and regulations prior to the issuance of said license and shall
continue to comply with the same during the term of the license.
A. Any building housing any domestic animals or fowl,
except cats and dogs, shall be at least 25 feet from the side line
of any street upon which the lot faces, and such building shall be
20 feet from any existing dwelling or place of habitation by human
beings on adjoining properties.
B. The owner or owners shall keep said coop, building
and/or yard reasonably clean at all times so as to prevent offensive
odors or an accumulation of manure and organic refuse which fosters
the breeding of flies.
The Board of Health may revoke any and all licenses
issued hereunder for violation of any of the provisions herein.

Any person or persons, firm or corporation violating
any of the provisions of this article shall be subject to a fine,
upon arraignment and conviction by the court or Judge before whom
the complaint is made, of not less than $5 nor more than $500, in
the discretion of the court or Judge imposing such fine.
