No retail liquor license of any class shall
be granted for or transferred to any premises within the Township
of Middle if the entrance to said premises is less than one mile from
the entrance to other premises covered by any other retail liquor
license of any class. Said distance of one mile shall be measured
along public highways using the shortest route between those public
entrances to each premises which are closest to each other.
Nothing herein contained shall be construed
to prohibit or prevent any of the following:
A.
The renewal of any retail liquor license of any class
for the same premises.
B.
The transfer of any retail liquor license of any class
to enlarged premises which include any portion of the premises already
covered by said license.
C.
The granting, renewing or transferring of any license
issued as a club license or hotel license.
D.
The transfer of any retail liquor license of any class
to premises within the one-mile prohibited area if the premises previously
covered by said license shall have been taken by any governmental
agency or board under authority of the right of eminent domain or
the right of condemnation for public purposes.
