A. 
There is hereby established in the Township of Middle a State Uniform Construction Code enforcing agency to be known as the "Department of Construction Inspection," consisting of a Construction Official, a Building Subcode Official, a Plumbing Subcode Official, an Electrical Subcode Official, a Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency. The Construction Official and the subcode officials shall be determined from time to time by resolution of the Township Committee.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to applicable statute or regulations. More than one such official position may be held by the same person, provided that such person is qualified pursuant to applicable statute or regulations to hold each such position.
C. 
The public shall have the right to do business with the enforcing agency at one office location, which shall be in the Township Hall, except for emergencies and unforeseen or unavoidable circumstances.
D. 
All subcode officials, their assistants and staff and all other personnel working for the Department of Construction Inspection shall be subject to the procedures and policies of said agency and shall be primarily responsible to the Construction Official.

A. 
Fees shall be in accordance with Uniform Construction Code as contained in New Jersey Administrative Code Section 5.23-4.20, a copy of which is annexed hereto and made a part hereof as if set forth at length, together with any and all New Jersey Administrative Code cites referred to in N.J.A.C. 5.23-4.20, Department fees.
B. 
Any change in fee structure or charges in the Uniform Construction Code, N.J.A.C. 5.23-4.20, shall be deemed to be, and are hereby, incorporated herein without the need of resolution or other authorization by the governing body of the Township of Middle.
C. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Township Committee, biannually, a report recommending a fee schedule based on the operating expenses of the agency and other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act. (See N.J.S.A. 52:27D-119 et seq.)
D. 
The administrative surcharge for private, on-site inspections and plan review agencies pursuant to N.J.A.C. 5:23-4.18(j) shall be 40% of the appropriate State of New Jersey subcode fee schedule.

E. 
No person shall be charged a construction permit fee for any construction, reconstruction, alteration or improvement designed and undertaken solely to promote accessibility by disabled persons to an existing private structure.
F. 
Certificates of occupancy for all new construction will not be issued until a surveyor's plot plan, certifying as to the exact location of all structures on said premises, is submitted together with a complete application.
