[HISTORY: Adopted by the Township Committee of the Township of Middle 3-6-1975 as Ord. No. 299-75. Sections 164-2, 164-3 and 164-4 amended at time of adoption of Code; see Ch. 1, General Provisions, Art. I. Other amendments noted where applicable.]

The provisions of the New Jersey State Housing Code, a true copy of which is on file in the office of the Township Clerk, are hereby adopted and incorporated as fully as if set out in length herein, as constituting the standards to guide the appropriate officials of the Township of Middle in determining the fitness of a building for human habitation, use or occupancy; provided, however, that Section 3, Water supply, and Section 4, Facilities, of said code shall not become effective until January 1, 1976, with respect to any dwelling unit or lodging house, unless said dwelling unit or lodging house has at any time previously met the standards of said sections, in which case said sections shall take effect immediately with respect to any such dwelling unit or lodging house.
The administrative authority provided in said code to administer the provisions thereof is the Board of Health and the Construction Official. The public officers provided for in said code shall be the Construction Official, Electrical Subcode Official, Plumbing Subcode Official and the Township Health Officer.

Construction Official, Electrical Subcode Official, Plumbing Subcode Official and the Township Health Officer shall all be guided in the exercise of the powers conferred upon them by law, by the provisions of the New Jersey State Housing Code, and shall use the standards set forth therein to guide them in determining the fitness of a building for human habitation, use or occupancy.

Any person, firm or corporation who shall violate any of the provisions of this chapter, including the provisions of the New Jersey State Housing Code which have been hereby adopted, shall, upon conviction, be punishable by one or more of the following: imprisonment not to exceed 90 days or a fine not to exceed $1,000 or a period of community service not to exceed 90 days. Each twenty-four-hour period that any violation continues to exist shall be deemed to be a separate offense and shall be punishable as aforesaid.
