The Township of Middle shall be vested with the power and shall prevent any encroachments, obstructions or encumbrances in, over or upon any street, highway, lane, side road, sidewalk or public place which has been deeded to the Township or dedicated and accepted by the Township or dedicated to the public use.
It shall be unlawful for any person to erect or construct any stoop, steps, platform, window, cellar door, sidewalk, passageway, descent into a cellar or basement, bridge, sign, areaway, post or any projection in, over or upon any street, lane, alley, side road, highway, sidewalk or public place.
It shall be unlawful for any person to erect, plant or maintain any fence, trees, wall, hedgerow or other form of enclosure or plant life which encroaches upon any municipal street, highway, lane, side road, sidewalk or public place or which fronts on, abuts or lies immediately adjacent to any municipal street, highway, lane, side road, sidewalk or public place.
Where any sidewalk, stoop, step, platform, window, cellar door, passageway, descent into a cellar or basement, bridge, sign, areaway, post or any projection in, over or upon any street, lane, alley, side road, highway, sidewalk or public place or any fence, trees, wall, hedgerow or other form of enclosure or plant life has already been erected or constructed or planted, it shall be removed at the expense of the owner or occupant of the premises or the person so creating the obstruction or encroachment.
No person shall deposit, throw, spill or dump dirt, ashes or other material upon any municipal street, highway, lane, side road, sidewalk or public place or permit the same to collect or accumulate so as to cause or create any nuisance, obstruction or encroachment upon any municipal street, highway, lane, side road, sidewalk or public place.
Where any dirt, ashes or other materials have already collected or accumulated or have already been deposited, spilled, thrown or dumped upon any municipal street, highway, lane, side road, sidewalk or public place, they shall be removed at the expense of the owner or occupant of the adjoining premises.
It shall be unlawful for any person to so use, operate or transport any plow, disc, tractor or other type of farm or construction machinery or equipment or to move any building or other heavy object over or upon any municipal street, highway, lane, side road, sidewalk or public place in such a manner as to cause damage thereto.
Where such plow, disc, tractor or other type of farm or construction machinery or the moving of any building or other heavy object causes damage and necessitates repairs to any municipal street, highway, lane, side road, sidewalk or public place, the expense and costs of repairs shall be charged against the person causing the damage.
The violation by any person of any section of this article shall, upon conviction, be punishable by one or more of the following: a fine of not more than $1,000 or imprisonment for not more than 90 days or a period of community service not to exceed 90 days.
