For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:
DEPARTMENT
The Department of Health and Welfare of the Village.
FOOD
Any edible matter, including any drink or beverage intended for human consumption on or off the premises.

A. 
Each person engaged within the Village in the business of preparing, selling or processing exposed food is required to obtain a food-handler's certificate, which shall be conspicuously displayed within the establishment or premises at or upon which such business is conducted.
B. 
This article shall not apply to any person subject to federal, state or county health regulations as to food handling upon satisfactory proof of compliance with such regulations being approved by the Department of Health and Welfare.

A. 
A food-handler's certificate shall be obtained from the Department of Health upon proof of successful completion of a course of instruction in health education, sanitation, personal hygiene, food poisoning, dishwashing procedures, insects, rodents and other related matters.
B. 
All food handlers are required to attend a food-handler's course of instruction within three months of employment. Any person who fails to successfully complete the course for any reason shall reapply for the next scheduled food-handler's course in the Village, in the county or in any other municipality offering certification.

A list of approved agencies and/or municipalities conducting such a course of instruction shall be maintained in the office of the Department and be available for public inspection during normal business hours.

The Department of Health and Welfare shall have the authority to revoke any food-handler's certificate issued pursuant to this article but only for cause and after notice to and hearing granted to the person holding such certificate.

All employers of persons required to hold food-handler certificates pursuant to this article shall maintain records of each such employee, listing his name and address, date of employment and number and date of the food-handler's certificate. Such records are to be made available to the Department of Health and Welfare or its authorized representatives at all times.

Each person required to obtain a food-handler's certificate shall pay a fee as set forth in Chapter 145, Fees, in order to attend the food-handler's course.

No person to whom a food-handler's certificate is issued shall give, loan, transfer or sell to or permit the same to be used by any other person.[1]

Any person engaged or employed in the business of preparing, selling or processing exposed food and having successfully completed a course of instruction in food handling is required to reattend a food-handler's course of instruction within a period of five years after the satisfactory completion of a course.

Any food establishment in the business of preparing, selling or processing exposed food which fails the health inspection two consecutive times within a period of one year shall require the managers and supervisors of each department (if applicable) to attend a twenty-hour food manager's certification course offered by the County Department of Health Services.

In the event that, pursuant to § 156-65.2, all managers or supervisors of the business fail to attend a food manager's course within three months of notification by the Department of Health, the Department of Health shall cite the establishment and conduct a hearing, the subject of which shall be revocation of the establishment's license to operate.
